Kyle Fredericks was acquitted on charges of trafficking a substance held out to be hydromorphone and criminal negligence causing death.

Kyle David Jamed Fredericks has been acquitted on charges of trafficking a substance held out to be hydromorphone and criminal negligence causing death.

Judge Alan Tufts said the Crown failed to prove the charges beyond a reasonable doubt. The charges stemmed from the death of Joshua Graves following a Berwick house party in March 2011.

Fredericks will be brought back to court momentarily to deal with charges of unlawfully escaping from custody.

UPDATE 10:50 a.m.:

Judge Alan Tufts has sentenced Kyle Fredericks, 21, to time served for escaping lawful custody. He pled guilty this morning.

Fredericks has been in custody on remand since escaping custody in 2012.

Another charge of breaching conditions has been dismissed.
