Intermittent custody
Michael Anthony Brown, 40, of Kentville, has been sentenced to intermittent custody for stealing a tablet from Staples Business Depot.
Brown changed his plea to guilty on Oct. 30 and the matter was adjourned to Nov. 15 for sentencing. Judge Ronda Van Der Hoek sentenced Brown to 30 days of intermittent custody, to be served from Fridays at 9 p.m. to Mondays at 6 a.m. beginning Dec. 1. Brown will be serving non-reporting probation while not in custody.
Brown committed the offence in New Minas on Jan. 10.
Breathalyser offences
Dino Armando Benini, 45, of Halifax, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Benini pleaded guilty on Nov. 14. Judge Ronda Van Der Hoek fined Benini a total of $1,300 and imposed a one-year driving prohibition against him.
Benini committed the offence in Windsor on Sept. 10. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Benini gave breathalyser readings of 110 and 100.
Jeffrey Vernon Dill, 57, of Sweets Corner, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Dill changed his plea to guilty on Nov. 14. Judge Ronda Van Der Hoek fined Dill a total of $1,300 and imposed a one-year driving prohibition against him.
Dill committed the offence in Windsor on Nov. 21, 2015. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Dill gave breathalyser readings of 180 and 170.
Tasha Nicole Farmer, 37, of Centre Burlington, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.
Farmer pleaded guilty to the charge on Nov. 14. Judge Ronda Van Der Hoek fined Farmer a total of $1,300 and imposed a one-year driving prohibition against her.
Farmer committed the offence in Upper Burlington on July 15. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Farmer gave breathalyser readings of 120 and 110.
Conditional discharge for various offences
Jacob Anthony Smith, 21, of Bishopville, has been handed a conditional discharge with probation for various offences, including assaulting a police officer engaged in the execution of his duty; wilfully damaging RCMP property, a marked police vehicle, to a value not exceeding $5,000; committing mischief by wilfully damaging a Sony Playstation and two counts of failing to comply with his undertaking. Smith was also fined for being intoxicated in a public place.
Smith pleaded guilty in November 2016 to four of the charges. The matters were adjourned to allow time for a pre-sentence report to be prepared, a sentencing circle to take place and for sentencing. Smith pleaded guilty to the remaining two charges on March 30, 2017.
On Nov. 16, Judge Alan Tufts handed Smith a conditional discharge with nine months of probation for assaulting a police officer, damaging police property, the mischief charge and the two undertaking offences. The court ordered Smith to complete 20 hours of community service work or to make a $200 donation to a registered charity in relation to the mischief charge. Smith was fined $75 for being intoxicated in a public place.
Smith committed the offences in Coldbrook on Jan. 3, 2016, in Bishopville on Nov. 9, 2016, and in Kentville on Feb. 18.
Conditional discharge for assault
Richard James MacDonald, 54, of Newport Station, has been handed a conditional discharge with probation for committing an assault.
MacDonald pleaded guilty to the charge on Nov. 14. Judge Ronda Van Der Hoek handed MacDonald a conditional discharge with eight months of probation.
MacDonald committed the offence in Newport Station on Sept. 6.
Suspended sentence with probation
Morgan Oliver Keddy, 21, of New Minas, has been handed a suspended sentence with probation for failing to comply with probation by failing to make restitution and for causing a disturbance in a public place by screaming, shouting or swearing.
Keddy changed his pleas to guilty on Nov. 14. Judge Alan Tufts handed Keddy a suspended sentence with nine months of probation on the two charges. Keddy has been ordered to make restitution in the amount of $135 to Ian Hutchinson Enterprises and must complete 10 hours of community service work.
Keddy committed the offences in Kentville on Dec. 31, 2016, and on April 24. A charge of mischief was dismissed with the Crown offering no evidence.
Fined for driving while disqualified
Jesse Elias Smith, 27, of Cambridge, has been fined for operating a motor vehicle while disqualified.
Smith changed his plea to guilty on Nov. 10. Judge Ronda Van Der Hoek fined Smith $130. No driving prohibition was imposed.
Smith committed the offence in Coldbrook on Dec. 6, 2016. A charge of failing to attend court in Kentville on April 25 as directed by a judge was dismissed on Nov. 10.
Committed mischief, peace bond offence
Jamie Albert Mason, 37, of Lower Sackville, has been fined and sentenced to probation for two counts of committing mischief by wilfully damaging property to a value not exceeding $5,000, one count involving a television and the other a rental property, and for breaching a peace bond recognizance.
Mason changed his pleas to guilty on Nov. 14. Judge Alan Tufts sentenced Mason to nine months of probation on the three charges and fined him $97.50 on each, for a total of $292.50 in fines.
Mason committed the offences in Waterville on April 23. A charge of assault, another count of mischief and a charge of stealing an iPad were dismissed with the Crown offering no evidence.
Undertaking offence, committed mischief
Darcy Richard Millard, 24, of Brooklyn, has been handed a suspended sentence with probation for failing to comply with his undertaking and committing mischief by wilfully damaging an RCMP security camera to a value not exceeding $5,000.
Millard pleaded guilty to the charges on Nov. 14. Judge Ronda Van Der Hoek handed Millard a suspended sentence with one year of probation, including restitution of $284.94 to the benefit of the Windsor Rural RCMP Detachment.
Millard committed the offences in Windsor on Aug. 9.
Stole from store, probation offence
Courtney Lynn Stronach, 28, of Wolfville, has been sentenced to time deemed served for stealing muffins from Walmart and failing to comply with probation.
Stronach was present in Kentville provincial court in custody on Nov. 14, when she pleaded guilty to both charges. Judge Alan Tufts sentenced Stronach to one day in custody deemed served on each count, concurrently, and released her on a current probation order.
Stronach committed the offences in New Minas on Nov. 13.
Failed to comply with recognizance
Philip Carl Caldwell, 39, of Greenwood, has been fined for failing to comply with his recognizance.
Caldwell changed his plea to guilty on Nov. 14. Judge Alan Tufts fined Caldwell a total of $325.
Caldwell committed the offence in Greenwood between Jan. 15 and 29. A charge of uttering a threat to cause death or bodily harm was dismissed with the Crown offering no evidence.
