Custody for property, firearm offences
William Brian Farrow, 29, of Windsor, has been sentenced to jail time for stealing a donation box with change from Tim Hortons, possessing a Mossberg bolt action rifle without holding the necessary licence and two counts of possessing stolen property of a value not exceeding $5,000.
Farrow changed his pleas to guilty on July 16. Judge James Burrill sentenced Farrow to five months in custody on each charge, to be served consecutively, for a total of 20 months in custody. Farrow was fined $13 on each charge, for a total of $52 in fines.
Farrow committed the offences in Windsor on Jan. 29 and March 6. Charges of breaking and entering a home and stealing firearms; break, enter and theft from the Windsor Hantsport Railway Company, stealing scrap metal from the Windsor Hantsport Railway Company and possessing an instrument suitable for the purpose of break and enter, a baseball bat, were dismissed on July 16 with the Crown offering no evidence.
A co-accused, Leonard Wade Greenough, 24, of Windsor, was present in provincial court on July 16. The defence requested an adjournment due to disclosure issues, which was granted. Greenough is scheduled to return to court on Aug. 3 for a pre-trial conference and to set new trial dates. He is also charged with transferring a non-restricted firearm without authorization.
Conditional sentence for sexual assault
Francis Michael Smith, 65, of Lake Paul, will serve a period of imprisonment in the community for committing a sexual assault.
Smith changed his plea to guilty on Nov. 22, 2017. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On July 16, Judge Alan Tufts handed Smith an eight-month conditional sentence order with house arrest for the first five months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining three months. The conditional sentence will be followed by 12 months of probation. The court imposed a 10-year Sex Offender Information Registration Act (SOIRA) order against Smith and granted a primary DNA order. Smith was fined $100 in victim surcharges.
Smith committed the offence in Lake Paul on July 3, 2016.
Failed to comply with SOIRA order
John Joseph Earl Howard, 24, of Kentville, has been fined for failing to comply with a Sex Offender Information Registration Act (SOIRA) order by not reporting a change in residency to the registration centre within seven days.
Howard pleaded guilty to the charge on July 17. Judge Christopher Manning fined Howard a total of $390.
Howard committed the offence in New Minas between Jan. 8 and April 16.
Curative treatment discharge
David Anthony McEachern, 36, of Harmony, has been handed a curative treatment conditional discharge for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
McEachern pleaded guilty to the charge on May 1 and the court imposed a one-year driving prohibition against him. The matter was adjourned to allow time for a pre-sentence report to be prepared and for McEachern to make an application for a curative treatment conditional discharge.
On July 16, with the consent of the Crown, Judge Alan Tufts handed McEachern a curative treatment conditional discharge with 24 months of probation. He was fined $100 in victim surcharges.
McEachern committed the offence in Aldershot on Jan. 27. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. McEachern gave breathalyser readings of 110 and 110.
Breathalyser offence
Nicholas Alexander Escott, 34, of Centreville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Escott pleaded guilty to the charge on July 17. Judge Christopher Manning fined Escott a total of $1,300 and imposed a one-year driving prohibition against him.
Escott committed the offence in Port Williams on May 2. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Escott gave breathalyser readings of 110 and 110.
Probation offence
Barbara Jean Hebb, 35, of Lakeville, has been fined for failing to comply with probation by not complying with a daily curfew provision.
Hebb pleaded guilty to the charge on July 17. Judge Christopher Manning fined Hebb a total of $130.
Hebb committed the offence in Lakeville on June 25.
