Federal custody for drug offence
Michael Travis Quirk, 21, of North Alton, has been sentenced to federal custody for possessing cocaine for the purpose of trafficking.
Quirk elected provincial court and pleaded guilty to the charge on May 16. Judge Catherine Benton accepted a joint sentencing recommendation from the Crown and defence and sentenced Quirk to 27 months of federal custody. The court granted a forfeiture order for cash and a cell phone that were seized and imposed a lifetime firearm prohibition against Quirk.
Quirk committed the offence in North Alton on March 24.
Assault causing bodily harm
Aaron Richard Cogswell, 26, of Cambridge, has been handed a conditional sentence order with house arrest for committing an assault causing bodily harm.
Cogswell changed his plea to guilty on May 14. Judge Ronda Van Der Hoek handed Cogswell a conditional sentence order with house arrest for the first month, followed by daily curfew from 10 p.m. to 6 a.m. for the remaining five months. The conditional sentence will be followed by 12 months of probation. The court granted a DNA order and imposed a 10-year discretionary firearms prohibition against Cogswell.
Cogswell committed the offence in Kentville on Dec. 7, 2017. Charges of uttering a threat to cause bodily harm or death and unlawful confinement were dismissed on May 14 with the Crown offering no evidence.
Fined for drug possession
William George Strickland, 56, of Bishopville, has been fined for unlawfully possessing cannabis and unlawfully possessing oxycodone.
Strickland was originally charged with possessing cannabis for the purpose of trafficking and possessing oxycodone for the purpose of trafficking but changed his pleas to guilty to the lesser, included offence of possession on each count on May 11.
Judge Alan Tufts fined Strickland a total of $97.50 for unlawfully possessing cannabis and fined him a total of $780 for unlawfully possessing oxycodone.
Strickland committed the offences in Hantsport on March 13, 2017.
Assault, undertaking offence
Daniel Paul Davis, 26, of New Minas, has been handed a suspended sentence with probation for committing an assault and failing to comply with his undertaking.
Davis changed his pleas to guilty in January and the matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On May 14, Judge Ronda Van Der Hoek handed Davis a suspended sentence with 12 months of probation on the two charges.
Davis committed the offences in Avonport on March 24 and Sept. 12, 2017. Another count of failing to comply with his undertaking was dismissed on May 14.
Breathalyser Offence
Timothy Bruce Huxter, 53, of New Minas, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Huxter changed his plea to guilty on May 14. Judge Alan Tufts fined Huxter a total of $1,300 and imposed a one-year driving prohibition against him.
Huxter committed the offence in North Kentville on July 14, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Huxter gave breathalyser readings of 150 and 140.
Refused breathalyser
Darren Richard Daley, 56, of Somerset, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.
Daley changed his plea to guilty on May 15. Judge Ronda Van Der Hoek fined Daley a total of $1,950 and imposed a one-year driving prohibition against him.
Daley committed the offence in Berwick on July 6, 2017.
Probation, undertaking offences
David Christopher Bennett, 42, of Hants Border, has been fined for three counts of failing to comply with probation and one count of failing to comply with his undertaking.
Bennett changed his plea to guilty to one count of failing to comply with probation and pleaded guilty to the other three charges on March 27. The matters were adjourned to May 16 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Catherine Benton fined Bennett $195 on each of the four charges, for a total of $780 in fines.
Bennett committed the offences in Hants Border on Jan. 13 and 15 and on Feb. 27 and in Brooklyn, Hants County, on Jan. 15. Another count of failing to comply with probation was withdrawn on May 16.
Possessed ammunition while prohibited
Mark Walter Harris, 43, of New Minas, has been fined for possessing ammunition while prohibited from doing so.
Harris changed his plea to guilty on May 15. Judge Ronda Van Der Hoek fined Harris a total of $390 and the court granted a forfeiture order for eight unspent shotgun shells.
Harris committed the offence in New Minas on July 6, 2017.
Stole property from Walmart
Amanda Lee Rose Harvey, 27, of Kentville, has been fined for stealing property from Walmart valued at less than $5,000.
Harvey changed her plea to guilty on May 14. Judge Alan Tufts fined her a total of $100.10.
Harvey committed the offence in New Minas on June 3, 2017.
