Conditional sentence with house arrest
Kyle Keith Patrick Hefford-Power, 26, of Greenwood, has been handed a conditional sentence with house arrest and daily curfew for possessing not in excess of 3 kg of cannabis marijuana for the purpose of trafficking, possessing a firearm while prohibited and storing a firearm, two 12-gauge shotguns, in a careless manner.
Hefford-Power changed his pleas to guilty on Oct. 25 and the matters were adjourned to Dec. 20 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Alan Tufts handed Hefford-Power a 12-month conditional sentence order on the three charges, including house arrest for the first four months, followed by daily curfew from 10 p.m. to 6 a.m. for four months and from 12 a.m. to 6 a.m. for the remaining four months. The court imposed an 11-year firearm prohibition against Hefford-Power and granted a forfeiture order for items seized.
Hefford-Power committed the offences in Greenwood on Sept. 21, 2016. A charge of possessing two 12-gauge shotguns without the necessary licence was dismissed.
Suspended sentence for indecent act
Paul Richards, 45, of Hantsport, has been handed a suspended sentence with probation for committing an indecent act by exposing his penis and masturbating in the presence of an individual.
Richards changed his plea to guilty in October. The matter was adjourned to Dec. 15 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Ronda Van Der Hoek handed Richards a suspended sentence with nine months of probation.
Richards committed the offence in Hantsport on April 2.
Breathalyser offence, possessed cannabis
Adam Ogilvie, 20, of Kingston, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit and for possessing not in excess of 30 grams of cannabis marijuana.
Ogilvie pleaded guilty to the charges on Dec. 19. Judge Ronda Van Der Hoek fined Ogilvie a total of $1,560 for the breathalyser offence and imposed a one-year driving prohibition against him. Ogilvie was fined a total of $65 for unlawfully possessing cannabis.
Ogilvie committed the offences in Greenwood on Nov. 8. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Ogilvie gave breathalyser readings of 160 and 170.
A charge of operating a motor vehicle while his ability to do so was impaired by alcohol was withdrawn on Dec. 19.
Impaired driving
David Ian Legge, 48, of Mount Uniacke, has been handed a curative treatment discharge for operating a motor vehicle while his ability to do so was impaired by alcohol.
Legge pleaded guilty to the charge in August. The matter was adjourned to allow time for a pre-sentence report to be prepared, a curative treatment discharge application and sentencing. The court imposed a one-year driving prohibition against Legge.
On Dec. 15, Judge Ronda Van Der Hoek handed Legge a curative treatment discharge with 24 months of probation. Legge was fined $100 in victim surcharges.
Legge committed the offence in Mount Uniacke on May 19. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Legge gave breathalyser readings of 310 and 300.
Breathalyser offence
Kevin James Wade, 53, of Bridgetown, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Wade changed his plea to guilty on Dec. 18. Judge Alan Tufts fined Wade a total of $1,300 and imposed a one-year driving prohibition against him.
Wade committed the offence in New Minas on Jan. 24. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Wade gave breathalyser readings of 180 and 160.
Charges of operating a motor vehicle while his ability to do so was impaired by alcohol and failing to comply with his undertaking were dismissed on Dec. 18.
Fined for driving without valid licence
Dillion Roy Balsor, 20, of Grand Prairie, Alberta, has been fined for driving without a valid licence.
Balsor pleaded not guilty to an original charge of driving while his privilege of obtaining a licence was suspended in June and the matter was adjourned to Dec. 18 for trial. Prior to the scheduled trial, Balsor pleaded guilty to the lesser offence of driving without a valid licence. Judge Alan Tufts fined Balsor a total of $295.
Balsor committed the offence in Aylesford on Dec. 12, 2016. A charge of failing to comply with probation was dismissed after the accused agreed to enter into a 12-month peace bond with an individual.
Failed to comply with probation
Andrew Christopher Barrett, 30, of North Kentville, has been sentenced to time deemed served and fined for failing to comply with probation.
Barrett pleaded guilty to the charge on Dec. 19. Judge Ronda Van Der Hoek sentenced Barrett to one day in custody deemed served and fined him a total of $1,300.
Barrett committed the offence in Sheffield Mills between June 1 and 17.
