Breathalyser offences

Sean Graham Pickrem, of Albany, Annapolis County, has been fined and sentenced to probation for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Pickrem changed his plea to guilty on June 26. Judge Alan Tufts fined Pickrem a total of $1,100 and sentenced him to nine months of probation. The court imposed a one-year driving prohibition against Pickrem. He may apply for the ignition interlock program after three months.

Pickrem committed the offence in New Minas on Sept. 30, 2016. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Pickrem gave breathalyser readings of 180 and 180.

Wilmagene Belle Mills, 57, of Truro, has been handed a curative treatment discharge for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

Mills pleaded guilty to the charge on Jan. 17, when the court imposed a one-year driving prohibition against her. The matter was adjourned to June 28 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Jean Whalen handed Mills a curative treatment discharge with 18 months of probation and fined her $100 in victim surcharges.

Mills committed the offence in Avonport on Sept. 11, 2016. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Mills gave breathalyser readings of 180 and 170.

Time deemed served for various offences

Justin Reid Dunbar, 25, of North Kentville, has been sentenced to time deemed served for unlawfully being inside a house, possessing a prohibited weapon, nunchucks, for which he didn’t have a registration certificate issued to him and failing to comply with probation.

Dunbar was originally charged with break, enter and theft but pleaded guilty to the included offence of unlawfully being inside a house on June 28. He also pleaded guilty to the other two charges on June 28.

Judge Jean Whalen sentenced Dunbar to 115 days in custody for unlawfully being inside a house. He was given credit for 114 days served while remanded in custody, leaving one day in custody, which was deemed served. Dunbar was fined $200 in victim surcharges.

Dunbar was fined a total of $360 on the restricted weapon charge. The court imposed a five-year firearm prohibition against him and granted a forfeiture order for the nunchucks.

Dunbar was sentenced to one day in custody deemed served for failing to comply with probation and was fined $200 in victim surcharges.

Dunbar committed the offences in Kentville on May 29, 2016. Charges of possessing stolen property valued at less than $5,000 and failing to comply with his undertaking were dismissed.

Failed to make restitution

Jessy Owen Corbin, 26, of New Minas, has been handed a suspended sentence with probation for failing to comply with probation by failing to pay restitution as ordered by the court.

Corbin changed his plea to guilty on June 26. Judge Alan Tufts handed Corbin a suspended sentence with 12 months of probation, including restitution of $453.14 payable through the court to the victim of a previous offence. The restitution is to be paid at a rate of $50 per month starting July 31 and at the end of each month thereafter until paid in full.

Corbin changed his plea to guilty in January to a charge of failing to comply with probation by failing to refrain from the use, consumption and possession of alcoholic beverages. On June 26, Corbin was fined a total of $86.25.

Several other counts of failing to comply with probation and assault charges were dismissed on June 26.

Conditional discharge for uttering threat, assault

Jonathan George Harvey, 34, of no fixed address in New Minas, has been handed a conditional discharge with probation for uttering a threat to cause death to two individuals and committing an assault.

Harvey pleaded guilty to the charges in April. The matters were adjourned to June 26 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Harvey a conditional discharge with 12 months of probation and fined him a total of $200 in victim surcharges.

Harvey committed the offences in New Minas between Oct. 1 and Dec. 31, 2016, and on Jan. 1, 2017. Another count of uttering a death threat and a charge of taking a vehicle without the consent of the owner with the intent to drive it were withdrawn.

Conditional discharge for assault, probation offence

Brandon Matheson, 21, of Greenwood, has been handed a conditional discharge with probation for using a weapon, a chair, in committing an assault and failing to comply with probation.

Matheson pleaded guilty to the charges in April and the matters were adjourned to June 26 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Matheson a conditional discharge with 12 months of probation.

Matheson committed the offences in Greenwood on Jan. 25. Charges of uttering a death threat to two individuals and a charge of mischief were withdrawn.

Suspended sentence with probation for assault

Victor Eugene Fredericks, 45, of Kingston, has been handed a suspended sentence with probation for committing an assault.

Fredericks changed his plea to guilty on April 5. The matter was adjourned to June 27 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Alan Tufts handed Fredericks a suspended sentence with one year of probation and fined him $100 in victim surcharges.

Fredericks committed the offence in Kingston on June 24, 2016.

Fined for obstructing officer, probation offence

Bryce Douglas Brooks, 23, of Bayport, Lunenburg County, has been fined for wilfully obstructing a police constable engaged in the execution of his duty and failing to comply with probation by failing to abstain from the consumption of alcohol or alcoholic beverages.

Brooks changed his plea to guilty on the obstruction charge and pleaded guilty to the probation charge on June 27. Judge Alan Tufts fined Brooks a total of $345 on the obstruction charge and fined him a total of $345 for failing to comply with probation.

Brooks committed the offences in Bishopville on March 18, 2016, and on Jan. 20, 2017.

Stole from liquor store, probation offence

Jessica Toni Lea Davidson, 28, of Kentville, has been handed a suspended sentence with probation for stealing property from the Nova Scotia Liquor Corporation and failing to comply with probation with respect to reporting.

Davidson pleaded guilty to the charges on April 11. The matters were adjourned to June 28 allow time for a pre-sentence report to be prepared and for sentencing.

Judge Jean Whalen handed Davidson a suspended sentence with 12 months of reporting probation on the two charges and fined her a total of $200 in victim surcharges.

Davidson committed the offences in New Minas on July 20, 2016, and in Kentville between Aug. 5 and Nov. 9, 2016.

Time deemed served for recognizance offence

Leah Marie Moore, a.k.a. Leah Marie Hawley, has been sentenced to time deemed served for failing to comply with her recognizance.

Moore was present in Kentville provincial court in custody on June 26. Judge Alan Tufts sentenced her to one day in custody deemed served.

Moore committed the offence in Kentville on June 23.
