Intermittent custody, time deemed served

Darren Taylor Jackson, 46, of Lower Sackville, has been sentenced to intermittent custody for committing an assault with a weapon and has been sentenced to time deemed served for possessing a bolt-action rifle knowing he was not the holder of a licence or a registration certificate for the firearm; and possessing a bolt-action rifle while prohibited.

Following a trial, on June 14, Jackson was found guilty of the assault with a weapon charge. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Jackson was present in custody on other matters in Windsor provincial court on July 28. Judge Ronda Van Der Hoek sentenced him to 90 days of intermittent custody from Fridays at 8 p.m. to Mondays at 6 a.m. beginning July 28 and continuing until the 90 days is served. Jackson will serve probation while not in custody and for one year following the completion of his intermittent sentence.

The court imposed a lifetime firearm prohibition against Jackson and granted a primary DNA order. He was fined $200 in victim surcharges. Jackson committed the offence in Mount Uniacke on Jan. 26, 2016.

Jackson was present in Windsor provincial court in custody on July 25, when he changed his pleas to guilty on the two firearm charges. The matters were adjourned to July 28 to give the court time to consider a joint sentencing recommendation. Jackson consented to being remanded in custody.

Van Der Hoek accepted the joint sentencing recommendation on July 28. She gave Jackson credit at time-and-a-half for 231 days spent remanded, for a total remand credit of 346 days. Jackson was sentenced to 346 days on the charge of possessing a firearm without a licence or registration certificate, deemed served by his remand time.

Jackson was sentenced to 180 days in custody for possessing a firearm while prohibited, which was also deemed served by his remand time. The court imposed concurrent lifetime firearm prohibitions on both counts. Jackson was fined $400 in victim surcharges.

Jackson committed these offences in Sackville on Dec. 9, 2016.

Breathalyser offences

Jesse Fuller, 26, of Brooklyn Street, Kings County, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Fuller pleaded guilty to the charge on Aug. 1. Judge Theodore Tax fined Fuller a total of $1,300 and imposed a one-year driving prohibition against him.

Fuller committed the offence in North Alton on April 8. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Fuller gave breathalyser readings of 110 and 110.

Michael David Palmer, 51, of Somerset, has been fined and sentenced to probation for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Palmer pleaded guilty to the charge on Aug. 1. Judge Theodore Tax fined Palmer a total of $1,690, sentenced him to one year of reporting probation and imposed a one-year driving prohibition against him.

Palmer committed the offence in Berwick on June 28. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Palmer gave breathalyser readings of 170 and 170.
