Jail time for assaults, mischief, theft

Dillon Michael Hunter, 20, of Windsor, has been sentenced to jail time for two counts of assault; committing mischief by wilfully cutting holes in a chesterfield, pouring maple syrup into a TV and pouring ketchup and maple syrup on clothing; stealing a Nintendo Wii gaming system and failing to attend court as directed. He was also fined for failing to comply with his undertaking.

Hunter changed his pleas to guilty in July on one assault charge, the mischief charge and the theft charge. The matters were adjourned to Aug. 29 for sentencing. He changed his pleas to guilty on the second assault charge, the undertaking charge and failing to attend court on Aug. 29.

Taking time spent remanded in custody into account, Judge Alan Tufts sentenced Hunter to a total of 72 days in custody and one year of probation on the two counts of assault, the mischief charge, the theft charge and for failing to attend court. A secondary DNA order was granted. Hunter was fined a total of $195 for failing to comply with his undertaking.

Hunter committed the offences in Windsor on April 29, May 1, May 17 and May 30. A charge of unlawfully possessing marijuana was withdrawn on May 30. Two more counts of mischief were dismissed on Aug. 29.

Windsor woman accused of bomb threat remains in custody

A Windsor woman accused of making a bomb threat has consented to being remanded in custody until October.

Michelle Mary Bonvie, 26, was present in Windsor provincial court in custody on Aug. 25. The Crown continues to be opposed to her release. Bonvie consented to being remanded in custody until Oct. 2 for a bail hearing and plea.

Bonvie is charged with committing mischief by calling in a bomb threat to Donnie’s Taxi in Windsor on Aug. 21. She’s also charged with failing to comply with probation and failing to comply with her undertaking. The charges have not been proven in court.

Conditional sentence with house arrest

Martin Leroy Cleveland, 26, of Kentville, has been handed a conditional sentence with house arrest for possessing stolen property valued at less than $5,000, failing to comply with probation and failing to comply with his undertaking.

Cleveland changed his pleas to guilty on Aug. 30. Judge Alan Tufts handed Cleveland a 90-day conditional sentence order with house arrest for the entire time and sentenced him to one year of probation. Cleveland was ordered to pay $50 in restitution to Apple Valley Pawn in relation to the stolen property charge. Cleveland was fined a total of $300 in victim surcharges.

Cleveland committed the offences in Kentville on Aug. 11, 2016. Charges of defrauding the Bank of Montreal of a sum of money not exceeding $5,000, another count of possessing stolen property, another count of failing to comply with probation and another count of failing to comply with his undertaking were dismissed in March.

Charges of possessing a stolen antique Gillette razor and stolen antique pocket watches and another count of failing to comply with his undertaking were dismissed on Aug. 30 with the Crown offering no evidence.

Fine, probation for drug production

Raymond Patrick Curran, 54, of Waterville, has been fined and sentenced to probation for unlawfully producing cannabis marijuana.

Curran pleaded guilty to the charge on Aug. 29. Judge Ronda Van Der Hoek fined him a total of $390 and sentenced him to 12 months of probation. The court imposed a 10-year firearm prohibition against Curran with a 30-day grace period to dispose of any firearms in his possession. The court granted a forfeiture order for offence-related items in relation to the Controlled Drugs and Substances Act charge, including marijuana plants, scales and baggies.

Curran committed the offence in Waterville on May 30.

Breathalyser offences

Joey Daymond Deveau, 38, of Auburn, has been fined and sentenced to probation for two counts of having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Deveau pleaded guilty to one count and changed his plea to guilty on the second charge on Aug. 29. Judge Ronda Van Der Hoek fined Deveau $1,625 on the first count and $1,950 on the second. Deveau was sentenced to a total of 12 months of probation. The court imposed an 18-month driving prohibition against Deveau on the two charges.

Deveau committed the offences in Somerset on Feb. 19 and in Welsford on May 4. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Deveau gave breathalyser readings of 300 and 300 on Feb. 19 and gave readings of 300 and 280 on May 4.

 

David Banks, 48, of Steam Mill, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Banks pleaded guilty to the charge on Aug. 29. Judge Ronda Van Der Hoek fined Banks a total of $1,300 and imposed a one year driving prohibition against him.

Banks committed the offence in North Kentville on June 18. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Banks gave breathalyser readings of 100 and 90.

Impaired driving

Dale Allen Toole, 47, of Torbrook, has been fined for operating a motor vehicle while his ability to operate was impaired by alcohol.

Toole changed his plea to guilty on Aug. 30. Judge Alan Tufts fined Toole a total of $1,300 and imposed a one-year driving prohibition against him.

Toole committed the offence in Greenwood on March 19, 2016. His blood alcohol readings were not available. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.

Refused breathalyser

Alain Mariano Manalo, 35, of Kentville, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.

Manalo pleaded guilty to the charge on Aug. 29. Judge Ronda Van Der Hoek fined him a total of $1,300 and imposed a one-year driving prohibition against him.

Manalo committed the offence in Kentville on July 9. A charge of operating a motor vehicle while his ability to do so was impaired by alcohol or a drug was withdrawn.

Conditional discharge for assault, uttering threat

Myles Richard Haight, 25, of Centreville, has been handed a conditional discharge with probation for committing an assault and uttering a threat to cause bodily harm.

Haight changed his pleas to guilty in June and the matters were adjourned to Aug. 30 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek handed Haight a conditional discharge with eight months of probation and fined him a total of $200 in victim surcharges.

Haight committed the offences in Centreville on Nov. 4, 2016. A charge of possessing a weapon for a purpose dangerous to the public peace was withdrawn on Aug. 30.

Conditional discharge for assault

Raymond Halime Toulany, 52, of Windsor, has been handed a conditional discharge with probation for committing an assault.

Toulany changed his plea to guilty on July 7. The matter was adjourned to Aug. 29 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Toulany a conditional discharge with six months of probation.

Toulany committed the offence in Windsor on Feb. 3.

Fined for stealing, transferring firearms without authority

Matthew Colin Tooker, 25, of Greenwood, has been fined for stealing meat products, laundry detergent and motor oil from the Atlantic Superstore and for the included offence of transferring firearms without authority.

Tooker pleaded guilty in April to the theft charge and pleaded guilty to the included offence of transferring firearms without authority. He had originally been charged with transferring two 12-gauge shotguns knowing that he was unauthorized to do so. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On Aug. 30, Judge Alan Tufts fined Tooker $325 for stealing property and fined him $325 for transferring firearms without authority. He was sentenced to one year of probation on the two charges. Tooker was ordered to pay $212.47 in restitution to the Atlantic Superstore in Kingston in relation to the theft charge and the court imposed a discretionary five-year firearm prohibition against him in relation to the firearm charge. The court imposed a forfeiture order for the two guns, subject to redemption by the rightful owner.

Tooker committed the offences in Kingston on Sept. 1, 2016, and in Greenwood on Sept. 15, 2016.

Suspended sentence for stealing from store

Maurice Frederick Currie, 63, of New Minas, has been handed a suspended sentence with probation for stealing property valued at less than $5,000 from the Atlantic Superstore.

Currie pleaded guilty to the charge on Aug. 29. Judge Ronda Van Der Hoek handed Currie a suspended sentence with six months of probation.

Currie committed the offence in New Minas on May 31.
