Suspended sentence for assault causing bodily harm

Caitlyn Anges Melanson, 28, of Lower Sackville, has been handed a suspended sentence with probation for committing an assault causing bodily harm.

Following a trial, Melanson was found guilty on June 14. The matter was adjourned to July 25 to allow time for a pre-sentence report to be prepared and for sentencing.

Accepting a joint sentencing recommendation, Judge Ronda Van Der Hoek handed Melanson a suspended sentence with one year of probation and fined him $200 in victim surcharges. The court granted a primary DNA order.

Melanson committed the offence in Mount Uniacke on Jan. 26, 2016.

Refused breathalyser, resisted arrest

Blair Philip Kenneally, 56, of Harbourville, has been fined and handed a suspended sentence for failing or refusing to comply with a demand made to him by an RCMP constable to accompany him for the purpose of enabling breath samples to be taken; and resisting a police constable engaged in the execution of his duty to arrest Kenneally for impaired operation of a motor vehicle by running away on foot.

Kenneally pleaded guilty to the charges. On July 24, Judge Alan Tufts fined Kenneally $1,560 on the refusal charge and handed him a one-year driving prohibition. Kenneally was handed a suspended sentence with nine months of probation and was fined $100 in victim surcharges for resisting police.

Kenneally committed the offences in Garland on May 24.

Breathalyser offence

Shawn Robert Craig Harding, 25, of East Uniacke, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Harding changed his plea to guilty on July 21. Judge Ronda Van Der Hoek fined Harding a total of $1,560 and imposed a two-year driving prohibition against him.

Harding committed the offence in Windsor on April 29. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Harding gave breathalyser readings of 180 and 170.

Conditional discharge for assault

Taylor Bo-Ming Hung, 22, of Lawrencetown, has been handed a conditional discharge with probation for committing an assault.

Hung pleaded guilty on May 11 and the matter was adjourned to July 24 to allow time for a pre- sentence report to be prepared and for sentencing.

Judge Alan Tufts handed Hung a conditional discharge with nine months of probation and fined Hung $100 in victim surcharges.

Hung committed the offence in New Minas on Aug. 2, 2016.

Recognizance offence

Kerry Lee Sampson, 31, of Windsor, has been sentenced to time in custody for failing to comply with his recognizance by failing to remain in his residence at all times.

Sampson was present in Windsor provincial court in custody on July 25, when he changed his plea to guilty. Judge Ronda Van Der Hoek accepted a joint recommendation from the Crown and defence in sentencing Sampson to 30 days in custody.

Sampson committed the offence in Windsor between July 8 and 9.

Conditional discharge for various offences

Alexander Patrick Hubley, 18, of Timberlea, has been handed a conditional discharge with probation for failing to comply with his recognizance by having contact with an individual, assault and unlawfully being inside a house.

Hubley pleaded guilty on July 25 to failing to comply with his recognizance. He committed the offence in Wolfville between Nov. 8 and Dec. 6, 2016.

Hubley was originally charged with break and enter and committing an indictable offence but pleaded guilty on Feb. 2 to the lesser offence of unlawfully being inside a house. Hubley also pleaded guilty to the assault charge on Feb. 2. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Hubley committed these offences in Wolfville on Sept. 4, 2016.

On July 25, Judge Alan Tufts handed Hubley a conditional discharge with 15 months of probation. Hubley was fined a total of $500 in victim surcharges.

Conditional discharge for assault

Chadain Campbell, 34, of Lower Canard, has been handed a conditional discharge with probation after pleading guilty to the included offence of assault.

Campbell was originally charged with sexual assault but pleaded guilty to the lesser, included offence of assault on May 30. The matter was adjourned to July 26 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek handed Campbell a conditional discharge with 12 months of probation, fined him $100 in victim surcharges and ordered him to make a $100 charitable donation to Chrysallis House.

Campbell committed the offence in Lower Canard on Oct. 13, 2016.

Failed to comply with probation

Nicholas Kent Coldwell, 30, of Coldbrook, has been sentenced to time deemed served and fined for failing to comply with probation.

Coldwell changed his plea to guilty on May 3. The matter was adjourned to July 26 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek sentenced Coldwell to one day in custody deemed served and fined him a total of $325.

Coldwell committed the offence in Coldbrook on Sept. 15, 2016.
