Defrauded Department of Community Services

Sue Anne Smith, 50, of Hantsport, has been fined and sentenced to probation for defrauding the Department of Community Services of money exceeding $5,000.

Smith pleaded guilty to the charge on April 4 and the matter was adjourned to May 29 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek fined Smith a total of $1.30 and sentenced her to one year of probation.

Smith committed the offence in Windsor between Jan. 1, 2010, and Dec. 31, 2013. According to court records, Smith defrauded community services of $8,360.

Impaired care or control of vehicle

Dwayne Donald Sangster, 43, of Stewiacke, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Sangster changed his plea to guilty on May 29. Judge Ronda Van Der Hoek fined Sangster a total of $1,300 and imposed a one-year driving prohibition against him.

The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Sangster’s blood alcohol reading was 110.

Impaired operation of vehicle

James Leslie Logue-Prest, 29, of Wolfville, has been fined for operating a motor vehicle while his ability to operate a vehicle was impaired by alcohol or a drug.

Logue-Prest changed his plea to guilty on May 31. Judge Ronda Van Der Hoek fined him a total of $1,300 and imposed a one-year driving prohibition against him.

Logue-Prest committed the offence in Wolfville on Aug. 11, 2016.

Conditional discharge for possessing stolen property

Barbara Jean Hebb, 33, of Brow of Mountain, has been handed a conditional discharge with probation for two counts of possession of stolen property valued at less than $5,000.

Hebb pleaded not guilty to an original charge of breaking and entering a house and committing an indictable offence therein in December. On May 17, she pleaded guilty to the lesser offence of possessing stolen property.

Hebb had changed her plea to guilty to the other possession of stolen property charge in March. Both matters were adjourned to May 30 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Alan Tufts handed Hebb a 12-month conditional discharge with probation on the two counts. She was fined a total of $200 in victim surcharges.

Hebb committed the offences in in Forest Hill on April 26, 2016, and on Brooklyn Street in Kings County on April 28, 2016. Another charge of breaking and entering a house and committing an indictable offence therein was dismissed on May 30.

Custody deemed served, probation

Pieter Lewis Johnstone, 28, of Centreville, has been sentenced to time deemed served and probation for assault, failing to comply with probation and mischief.

Johnstone changed his pleas to guilty to the charges on May 30. Judge Alan Tufts sentenced Johnstone to one day in custody deemed served on each charge and a total of two years of probation. Johnstone was fined $300 in victim surcharges. The court granted a DNA order and imposed a three-year firearm prohibition in relation to the assault charge.

Johnstone committed the offences in Waterville on March 16 and 18. Another count of assault was dismissed.

Conditional discharge for stealing, probation offence

William James McKeown, 20, of no fixed address, has been handed a conditional discharge with probation for stealing property valued at less than $5,000 from Jason’s Independent Grocer.

McKeown pleaded guilty to the charge on March 28 and the matter was adjourned to May 30 to allow time for a pre-sentence report to be updated and for sentencing. Judge Alan Tufts handed McKeown a conditional discharge with six months of non-reporting probation. McKeown was fined $100 in victim surcharges.

McKeown committed the offence in Kentville on Jan. 24. A charge of failing to comply with probation was withdrawn.

A co-accused, Brian Joseph Johnson, 29, of Kentville, was not present in court on May 23. A warrant for his arrest was authorized.
