Federal sentence for possessing cocaine, marijuana for trafficking
A North Alton man will serve federal jail time for unlawfully possessing cocaine and marijuana for the purpose of trafficking.
Michael Quirk, 20, pleaded guilty to the two charges in September 2016. The guilty pleas were confirmed on June 14.
Judge Ronda Van Der Hoek sentenced Quirk to two years in custody on each charge, to be served concurrently.
The court granted a secondary DNA order and a forfeiture order for items seized in relation to the Controlled Drugs and Substances Act charges. The court also imposed a 10-year firearm prohibition against Quirk. He was fined $400 in victim surcharges. Quirk committed the offences in Kentville on April 19, 2016.
Quirk also pleaded guilty on June 14 to two counts of failing to attend court as required by a judge and one count of failing to comply with his recognizance.
Quirk was fined $57.50 for one count of failing to attend court. He was fined $86.25 for the other count of failing to attend court and was fined $86.25 for failing to comply with his recognizance.
Quirk committed these offences in Kentville on Oct. 5, 2016, between Jan. 12 and June 10, 2017, and on May 31, 2017.
Jail time for probation offence
Curtis Spencer Leefe, 32, of Kentville, has been sentenced to time in custody for failing to comply with probation.
Leefe was present in Kentville provincial court in custody on June 12, when he pleaded guilty to the charge. Judge Ronda Van Der Hoek sentenced Leefe to 35 days in custody and fined him $100 in victim surcharges.
Leefe committed the offence in Coldbrook on June 6. Five more counts of failing to comply with probation were withdrawn on June 12.
Courtney Lynn Stronach, 28, of Port Williams, has been sentenced to time in custody for failing to comply with probation.
Stronach was present in Kentville provincial court on June 12, when she pleaded guilty to the charge. Judge Ronda Van Der Hoek sentenced Stronach to 11 days in custody and fined her $100 in victim surcharges.
Stronach committed the offence in Coldbrook on June 6. Two more counts of failing to comply with probation were withdrawn on June 12.
Suspended sentence for attempted strangulation, drug possession
Elizabeth Anne Smith, 55, of Windsor, has been handed a suspended sentence with probation for attempting to strangle a man using a nylon rope with the intent to enable herself to commit the indictable offence of assault and unlawfully possessing cannabis marijuana.
Smith pleaded guilty to the charges on April 25 and the matters were adjourned to June 13 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Smith a suspended sentence with one year of probation on the two charges.
Smith committed the offences in Windsor on March 9. The Crown withdrew charges of assault and carrying a weapon, a pipe wrench, for a purpose dangerous to the public peace.
Not guilty of possessing cocaine for purpose of trafficking
Travis Wayne Riley, 26, of North Kentville, has been found not guilty and acquitted on a charge of unlawfully possessing cocaine for the purpose of trafficking.
Riley pleaded not guilty to the charge in January and the matter was adjourned for trial. Judge Ronda Van Der Hoek handed down her decision on June 13, finding Riley not guilty.
It had been alleged that Riley committed the offence in Kentville on July 27, 2016.
Suspended sentence for break and enter, other offences
Justin Gerald Bartlett, 27, of Windsor, has been handed a suspended sentence with probation for breaking and entering an apartment with intent to commit an indictable offence therein, committing mischief by damaging the walls and door of an apartment to a value not exceeding $5,000 and failing to attend court as required by a judge.
Bartlett pleaded guilty to the charges on June 13. Judge Alan Tufts handed Bartlett a suspended sentence with six months probation on each count, to be served concurrently.
Bartlett committed the offences in in Windsor on Dec. 26, 2015, and Nov. 4, 2016.
Stole money from Dooly’s
Sidney Mary Louise McIlroy, 24, of Greenwood, has been handed a conditional discharge with probation for stealing less than $5,000 from Dooly’s.
McIlroy pleaded guilty to the charge on May 9 and the matter was adjourned to June 14 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Ronda Van Der Hoek handed McIlroy a conditional discharge with one year of probation and fined McIlroy $200 in victim surcharges.
McIlroy committed the offence in Greenwood on Sept. 12, 2016. A charge of stealing in excess of $5,000 from Dooly’s was withdrawn.
Suspended sentence for various offences
Kyle Michael Whiston, a.k.a. Kyle Michael Crouse, has been handed a suspended sentence with probation for two counts of failing to comply with his undertaking, two counts of failing to comply with probation and possessing stolen property of a value not exceeding $5,000.
Whiston, who earlier pleaded guilty to the charges, was handed a suspended sentence with 12 months of reporting probation on the five charges on June 14.
Whiston committed the offences in Middleton between Oct. 7, 2015, and Oct. 6, 2016; and in Kingston on June 17, 18 and 19, 2016.
Undertaking offence
Cody Dent, 20, of Meadowvale, Annapolis County, has been handed a conditional discharge with probation for failing to comply with his undertaking.
Dent changed his plea to guilty in March and the matter was adjourned to June 14 for sentencing. Judge Ronda Van Der Hoek handed Dent a conditional discharge with six months of probation and fined him $100 in victim surcharges.
Dent committed the offence in Meadowvale on June 14, 2016. A charge of criminal harassment was dismissed.
