Fined for property offences

Alexander Hodder, 20, of Kentville, has been fined for trespassing at night, possession of break and enter instruments and failing to comply with probation.

Hodder was originally charged with break, enter and theft from a transport trailer at the Frito Lay factory in New Minas but pleaded guilty to the lesser, included offence of trespassing at night and the other two charges on Dec. 20, 2016. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Alan Tufts fined Hodder $325 for trespassing; $260 for possessing break and enter instruments and $130 for failing to comply with probation. Hodder was sentenced to a total of six months of probation on the three charges.

Hodder committed the offences in New Minas on July 7, 2016.

Conditional sentence for assaults, failing to comply

Nicole Lynn Swinamer, 27, of Greenwood, has been handed a conditional sentence order with daily curfew and sentenced to probation for two counts of assault, failing to comply with her recognizance and failing to comply with probation.

Swinamer pleaded not guilty to all charges against her on Oct. 11, 2016. The matters were adjourned to March 20, 2017, for trial. Swinamer was originally charged with assault with a weapon but pleaded guilty to the lesser, included offence of assault on March 20. She changed her pleas to guilty to the other count of assault and the probation and recognizance charges on March 20. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On Sept. 19, Judge Alan Tufts handed Swinamer a four-month conditional sentence with daily curfew from 7:30 p.m. to 6:30 a.m. for the entire time. This will be followed by 12 months of reporting probation.

Swinamer committed the offences in Kentville on June 6, 2016. Two more counts of assault and a charge of mischief were dismissed on Sept. 19 with the Crown offering no evidence.

Refused breathalyser

Kyle Leslie Pineo, 25, of Kentville, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.

Pineo changed his plea to guilty on Sept. 18. Judge Alan Tufts fined Pineo a total of $1,300 and imposed a one-year driving prohibition against him.

Pineo committed the offence in New Minas on Feb. 28, 2016. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.

Conditional discharge for assault

John David Elliott Gregory, 34, of New Minas, has been handed a conditional discharge with probation for committing an assault.

Gregory changed his plea to guilty on Sept. 18. Judge Alan Tufts handed Gregory a conditional discharge with six months of probation.

Gregory committed the offence in New Minas on Oct. 17, 2016.

Suspended sentence for uttering threat

Adrian Michael Smith, 27, of Arlington, has been handed a suspended sentence with probation for uttering a threat to cause bodily harm to an individual.

Smith changed his plea to guilty on Sept. 14. The matter was adjourned to Sept. 19 for sentencing. Judge Alan Tufts handed Smith a suspended sentence with 12 months of probation and fined him $100 in victim surcharges.

Smith committed the offence in Canning on May 23, 2016.
