WINDSOR, NS - A Lower Sackville man charged following an attempted robbery at an ATM in Greenwood will be back in court in March for election and plea and sentencing on an unrelated charge.
Brandon David Smith, 29, is charged with using threats of violence in attempting to steal money from an individual; uttering a death threat, failing to comply with the house arrest provision of his recognizance, having his face masked with intent to commit the indictable offence of robbery, failing to comply with his recognizance by failing to keep the peace and be of good behaviour and uttering threats involving a weapon while committing the indictable offence of robbery.
It’s alleged that Smith committed the offences in Greenwood on Jan. 31. The charges have not been proven in court.
The accused was present in Windsor provincial court in custody on Feb. 13. The defence requested an adjournment to March 20 for a bail hearing and election and plea. Smith has been remanded in custody until his next court date.
According to an RCMP news release, a 17-year-old male victim was using the Scotiabank ATM on Central Avenue in Greenwood at 9:16 p.m. on Jan. 31 when a man allegedly came up to him, told him he was carrying a weapon and demanded that he withdraw all funds from his bank account.

The young man refused and the alleged assailant ran away empty handed. The victim didn’t see a weapon at any point during the incident. Smith was arrested in Kingston on Feb. 2.
Smith also appeared in court on other charges on Feb. 13. His sentencing on a charge of break and enter with intent to commit an indictable offence was adjourned to March 20 at the request of the defence. Smith committed this offence in Mount Uniacke on Feb. 18, 2015.
Smith is facing several other charges alleged to have occurred in Mount Uniacke on Feb. 18, 2015. These include aggravated assault, stealing $500 and a cell phone from an individual and possessing a weapon – a knife and a baseball bat – for the purpose of committing an offence. These charges have been adjourned to March 20 for disposition.
Smith was charged jointly with Richard George Mahar, 37, of Dartmouth, on the Mount Uniacke charges. A charge of attempted murder against the co-accused was discharged following a preliminary inquiry on May 1, 2017. Smith and Mahar were committed to Supreme Court on the remaining charges but they re-elected provincial court on Dec. 6, 2017.
Smith changed his plea to guilty on the charge of break and enter with intent to commit an indictable offence on Dec. 8, 2017, and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Remaining charges against Mahar were dismissed without penalty on Dec. 8, 2017.
