This is the latest court report for Kings and West Hants counties.

Conditional sentence for assault, uttering threat

Cody Derek Meisner, 31, of Port Williams, will serve a period of imprisonment in the community for committing an assault and uttering a threat to cause bodily harm.

Meisner changed his pleas to guilty on March 4 and the matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On June 20, Judge Christopher Manning handed Meisner a four-month conditional sentence order with house arrest for the first two months, to be followed by daily curfew from 10 p.m. to 5 a.m. for the remaining two months. Meisner was also sentenced to 12 months of probation. The court granted secondary DNA orders for both offences and imposed a four-year, four-month firearms prohibition against Meisner. He has been given 30 days to surrender any firearms in his possession.

Meisner committed the offences in Aylesford between Jan. 1, 2013, and Sept. 10, 2016, and in North Kentville between Jan. 1, 2016, and Aug. 12, 2018.

Two more counts of assault, another count of uttering a threat to cause bodily harm and two counts of uttering death threats were dismissed on June 20.

Probation, fines for various offences

Daniel John Bigelow, 26, of Steam Mill, has been fined and sentenced to probation for committing an assault, storing firearms in a careless manner and two counts of failing to comply with his undertaking.

Bigelow changed his plea to guilty to the assault charge on Jan. 24 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. He changed his pleas to guilty to the careless storage of firearms charge and the two counts of failing to comply with probation on May 27. The matters were adjourned to June 20 for the continuation of Bigelow’s sentencing hearing.

Judge Christopher Manning fined Bigelow $250 and sentenced him to 12 months of probation on the assault charge. Bigelow was fined $150 on each of the undertaking charges and was sentenced to 12 months of probation – to be served concurrently - on the second count. He was fined $250 for carelessly storing firearms. The court granted a forfeiture order for a handgun, a rifle and a long gun and imposed a two-year firearms prohibition against Bigelow. He has been given 30 days to transfer any other firearms in his possession.

Bigelow committed the offences in Steam Mill on June 3 and Oct. 16, 2018. Another count of assault, a charge of pointing a firearm at an individual and a charge of unlawfully entering a house with intent to commit an indictable offence were dismissed on June 20.

Refused breathalyser, resisted police

Bernard Drew Parker, 25, of Windsor, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis by means of an approved screening device and resisting a police officer engaged in the execution of his duty.

Parker changed his pleas to guilty on April 24. The court imposed a one-year driving prohibition against Parker and the matters were adjourned to June 20 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning fined Parker $1,000 for refusing the breathalyser and handed him a conditional discharge with 12 months of probation for resisting police.

Parker committed the offences in Wolfville on Jan. 21, 2018. Two counts of assaulting a police officer engaged in the execution of his duty were dismissed on June 20. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.

Conditional discharge for drug offences

Bryan Jacob Canavan, 27, of Windsor, has been handed a conditional discharge with probation for two counts of possessing less than three kilograms of cannabis marijuana for the purpose of trafficking, two counts of possessing not in excess of three kilograms of cannabis resin for the purpose of trafficking and two counts of possessing the proceeds of crime.

Canavan changed his pleas to guilty on May 24 and the matters were adjourned to June 17 for sentencing.

Judge Ronda Van Der Hoek handed Canavan a conditional discharge with 18 months of probation on the six charges. The court granted a forfeiture order for offence-related property, granted a DNA order in relation to the possession for the purpose of trafficking charges and imposed a 10-year firearm prohibition against Canavan.

Canavan committed the offences in Windsor on Aug. 24 and on Oct. 18, 2017.

Trafficking, undertaking offences

Andrew Scott Ward, 40, of Windsor, has been handed a suspended sentence with probation for failing to comply with his undertaking by failing to abstain from the consumption of alcohol or other intoxicating substances and trafficking in a substance held out to be MDMA, also known as Molly.

Ward pleaded guilty to the trafficking charge on Jan. 2, 2018. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Sentencing submissions were made by the Crown and defence on May 28, 2019, and exhibits were entered. The matter was adjourned to June 17 for a decision on sentencing and the court granted a forfeiture order for offence-related property.

Judge Ronda Van Der Hoek handed Ward a suspended sentence with three years of probation, including 240 hours of community service work. The court granted a primary DNA order and imposed a 10-year weapons prohibition against Ward – with an exception for work-related purposes.

Ward pleaded guilty to the undertaking charge on May 28 and the matter was adjourned to June 17 for sentencing. Ward was fined $200.

Ward committed the offences in Windsor on July 17 and Aug. 5, 2018. A charge of unlawfully possessing MDMA was withdrawn on June 17.

Drug-impaired driving

Christopher Gary Corbin, 41, of Windermere, has been fined for operating a motor vehicle while his ability to do so was impaired by a drug.

Corbin changed his plea to guilty on June 18. Judge Christopher Manning fined Corbin $1,000 and imposed a one-year driving prohibition against him.

Corbin committed the offence in Grafton on March 16, 2018.

Breathalyser offence

Connor Ethan Robicheau, 22, of Magee Lake, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Robicheau pleaded guilty to the charge on June 18. Judge Christopher Manning fined Robicheau $1,000 and imposed a one-year driving prohibition against him.

Robicheau committed the offence in Wolfville on April 26. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Robicheau gave breathalyser readings of 100 and 100.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug, or both, was withdrawn on June 18.

Assault, undertaking offence

Shawn Michael Rogers, 32, of Kentville, has been handed a suspended sentence with probation for committing an assault and failing to comply with his undertaking.

Rogers changed his pleas to guilty on April 30. The matters were adjourned to June 20 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning handed Rogers a suspended sentence with 12 months of probation on the two charges.

Rogers committed the offences in Kentville on Sept. 16, 2018, and in New Minas on Dec. 13, 2018. Another count of failing to comply with his undertaking was withdrawn on June 20.

Recognizance, probation offences

Nathan Shane Atwell, 38, of Hantsport, has been handed a suspended sentence with probation for failing to comply with his recognizance and failing to comply with probation.

Atwell changed his pleas to guilty on March 26 and the matters were adjourned to June 18 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek handed Atwell a suspended sentence with 12 months of probation on the two charges.

Three more counts of failing to comply with his recognizance and three more counts of failing to comply with probation were withdrawn or dismissed on June 18.

Failed to report

Nicholas Sheldon Lee Corkum, 22, of Kentville, has been fined and sentenced to probation for failing to comply with probation with regard to reporting and being under the supervision of his probation officer.

Corkum pleaded guilty on June 18. Judge Christopher Manning fined Corkum $300 and sentenced him to six months of reporting probation.

Corkum committed the offence in Kentville on Feb. 24.
