Evaded police, failed to attend court
Jordan Russell Attwell, 21, of Cambridge, has been handed a conditional discharge with probation for failing to stop his vehicle as soon as was reasonable in the circumstances in order to evade police; and failing to attend court as required.
Attwell pleaded guilty to the charges on Sept. 11 and the matters were adjourned to Nov. 13 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Attwell a conditional discharge with 12 months of reporting probation on the two charges. Attwell has been ordered to complete 50 hours of community service work as part of his probation and the court imposed a six-month driving prohibition against him in relation to the charge of evading police.
Attwell committed the offences in Kentville on Sept. 5 and Nov. 7, 2017. Another count of failing to attend court as required was withdrawn on Nov. 13.
Impaired driving
Rae Lee Theda Giles, 31, of Hammonds Plains, has been fined for operating a motor vehicle while her ability to do so was impaired by alcohol or a drug.
Giles changed her plea to guilty to the charge on Nov. 13. Judge Christopher Manning filed Giles a total of $1,560 and imposed a one-year driving prohibition against her.
Giles committed the offence in New Minas on Aug. 26, 2017. Five counts of possessing stolen property of a value not exceeding $5,000 were dismissed on Nov. 13.
Conditional discharge for assault
Candace Lambert, 44, of Wolfville, has been handed a conditional discharge with probation for committing an assault.
Lambert pleaded guilty to the charge on Sept. 11 and the matter was adjourned to Nov. 13 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek handed Lambert a conditional discharge with one year of probation.
Lambert committed the offence in Wolfville on May 8.
Refused breathalyser
Lorilee Kendra Sealby, 45, of Greenwood, has been fined for failing to comply with a demand made to her by a police officer to provide samples of her breath for analysis to determine the concentration, if any, of alcohol in her blood.
Sealby pleaded not guilty in April 2017 to this charge and to a charge of operating a motor vehicle while her blood alcohol level exceeded the legal limit. The matters were adjourned for trial. The trial was held over several dates. Further evidence was heard on Oct. 30, when Sealby was acquitted on the impaired driving charge. The matter of the refusal charge was adjourned to Nov. 13 for a decision.
Judge Ronda Van Der Hoek found Sealby guilty on the refusal charge. Sealby was fined a total of $1,300 and the court imposed a one-year driving prohibition against her.
Sealby committed the offence at 14 Wing Greenwood on Jan. 28, 2017.
Uttered death threat, committed assault
Devn Kale Field, 18, of Grafton, has been handed a conditional discharge with probation for uttering a death threat and committing an assault.
Field was originally charged with using a weapon – an extension cord – in committing an assault but pleaded guilty to the lesser, included offence of assault on June 14. He pleaded guilty to the charge of uttering a death threat on July 30. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On Nov. 15, Judge Gregory Lenehan handed Field a conditional discharge with nine months of probation on the two charges. He was fined $100 in victim surcharges on each charge, for a total of $200 in fines.
Field committed the offences in Grafton on Feb. 2 and May 1. A charge of assault causing bodily harm was withdrawn on Nov. 15.
