Fine, probation for drug possession
Nathaniel John Labrador, 35, of East Kingston, has been fined and sentenced to probation for unlawfully possessing hydromorphone.
Labrador was originally charged with possession for the purpose of trafficking but pleaded guilty to the lesser, included offence of possession on July 9 with the consent of the Crown. The matter was adjourned to Sept. 17 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Christopher Manning fined Labrador a total of $390 and sentenced him to 12 months of probation.
Labrador committed the offence in Kingston on May 26, 2017.
Conditional sentence for various offences
Nicole Grace Danielle Veinot, 33, of Greenwood, will serve a period of imprisonment in the community for committing a variety of offences, including eight counts of stealing property valued at less than $5,000 from stores, two counts of failing to comply with her undertaking and one count of failing to comply with probation.
Veinot pleaded guilty to a charge of stealing merchandise of a value not exceeding $5,000 from the Greenwood Giant Tiger on Nov. 15, 2017. She pleaded guilty on June 5 to three more counts of stealing property from stores – the Kingston Superstore and the Kingston Nova Scotia Liquor Corporation – and to a count of failing to comply with her undertaking. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Veinot pleaded guilty to the other charges prior to her sentencing on Sept. 18.
Judge Christopher Manning handed Veinot a six-month conditional sentence order with house arrest for the first three months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining three months. She was also sentenced to 12 months of probation on the 11 counts.
Veinot committed the offences in Greenwood on Nov. 3, 2016 and on May 10, 2018; in Kingston on Sept. 12, 18, 21 and 25, 2017, and on July 12, 14 and 17, 2018; and in New Minas on Nov. 15, 2017. Five more counts of failing to comply with her undertaking and four more counts of failing to comply with probation were withdrawn on Sept. 18.
Veinot also pleaded not guilty on Sept. 18 to a charge of failing to comply with her undertaking in Kingston on May 5. This matter has been adjourned to Oct. 15 for trial.
Refused to provide breath sample
William Michael McDonald, 54, of Old School House Road, Annapolis County, has been fined for failing to comply with a demand made to him by a police officer to provide a sample of his breath for analysis to determine the concentration, if any, of alcohol in his blood.
McDonald changed his plea to guilty on Sept. 17. Judge Christopher Manning fined McDonald a total of $1,430 and imposed a one-year driving prohibition against him.
McDonald committed the offence in New Minas on Oct. 28, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.
Breathalyser offence
Kristin Nicole Lee, 20, of Ardoise, has been handed a curative treatment conditional discharge for operating a motor vehicle while her blood alcohol level exceeded the legal limit.
Lee pleaded guilty to the charge in March. The court imposed a one-year driving prohibition against Lee and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On Sept. 18, Judge Ronda Van Der Hoek granted a curative treatment conditional discharge with 12 months of probation.
Lee committed the offence in Ellershouse on Dec. 28, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Lee gave breathalyser readings of 220 and 230.
Breathalyser offence
Taryn Beth Marie Smith, 24, of Berwick, has been fined for having care or control of a motor vehicle while her blood alcohol level exceeded the legal limit.
Smith pleaded guilty to the charge on Sept. 19. Judge Christopher Manning fined Smith a total of $1,300 and imposed a one-year driving prohibition against her.
Smith committed the offence in Berwick on March 24, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Smith gave breathalyser readings of 130 and 120.
Time deemed served
Christopher Stephen Coleman, 34, of Windsor, has been sentenced to time deemed served for committing mischief by willfully damaging an apartment and furnishings to a value not exceeding $5,000 and for failing to comply with his recognizance by possessing cannabis marijuana.
Coleman was present in Windsor provincial court in custody on Sept. 17 when he pleaded guilty to the charges. Judge Ronda Van Der Hoek sentenced Coleman to one day in custody deemed served on each of the two counts. The court granted a stand-alone restitution order for $2,095 payable to the owner of the apartment.
Coleman committed the offences in Windsor between Sept. 4 and 11. Charges of failing to comply with his undertaking, unlawfully possessing cannabis marijuana and failing to comply with his recognizance were withdrawn on Sept. 17.
Conditional discharge for assault
Tanya Gladys Van Tassel, 48, of Berwick, has been handed a conditional discharge with probation for committing an assault.
Van Tassel was originally charged with assault causing bodily harm but pleaded guilty to the lesser, included offence of assault on July 31. The matter was adjourned to Sept. 18 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Christopher Manning handed Van Tassel a conditional discharge with nine months of probation and fined her $100 in victim surcharges.
Van Tassel committed the offence in Berwick on Oct. 6, 2017.
Conditional discharge for theft
Aaron Alexander Beal, 23, of Dartmouth, formerly of Kentville, has been handed a conditional discharge with probation and community service work for committing theft.
Beal was originally charged with break, enter and theft from a transport trailer at the Frito Lay factory in New Minas but pleaded guilty to the lesser, included offence of theft with the consent of the Crown on July 17. The matter was adjourned to Sept. 19 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Christopher Manning handed Beal a conditional discharge with nine months of probation, including 20 hours of community service work.
Beal committed the offence in New Minas on July 7, 2016.
Undertaking offence, mischief, caused disturbance
Carson Lee Bezanson, 34, of North Kentville, has been handed a suspended sentence with probation for failing to comply with his undertaking by failing to abstain from the consumption of alcohol or other intoxicating substances, committing mischief by willfully damaging a chair of the New Minas RCMP and causing a disturbance in a public place by screaming, shouting, swearing or using obscene or insulting language.
Bezanson pleaded guilty to the charges on July 31 and the matters were adjourned to Sept. 18 to allow time for a pre-sentence report to be updated and for sentencing. Judge Christopher Manning handed Bezanson a suspended sentence with 12 months of probation on the three charges.
Bezanson committed the offences in North Kentville and New Minas on Dec. 26, 2017, and in Kentville on Oct. 20, 2017.
