Time deemed served
Kevin Craig Hart, 48, of Country Harbour Mines, Guysborough County, has been sentenced to time deemed served and probation for committing an assault and two counts of failing to comply with his recognizance by failing to abstain from having contact or communication with an individual.
Hart pleaded guilty to the three charges on Aug. 8. Judge Alan Tufts sentenced Hart to 30 days in custody. Hart was given credit at time and a half for 20 days spent remanded in custody, or 30 days. He was sentenced to 15 months of probation on the three charges and the court imposed a five-year firearm prohibition in relation to the assault charge.
Hart committed the offences in East Dalhousie on July 20. He pleaded not guilty to two more counts of failing to comply with his recognizance. These two charges were dismissed without penalty on Aug. 8.
Evaded police, undertaking, recognizance offences
Michael Jody James Paul, 21, of Windsor, has been fined for failing to stop his vehicle as soon as was reasonable in the circumstances in order to evade police; failing to comply with his undertaking by failing to keep the peace and to be of good behaviour and failing to comply with his recognizance by failing to comply with daily curfew.
Paul changed his pleas to guilty to the charges of evading police and failing to comply with his undertaking and pleaded guilty to the charge of failing to comply with his recognizance on April 29. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On Aug. 6, Judge Christopher Manning fined Paul $100 for evading police; $50 for failing to comply with his undertaking and $50 for failing to comply with his recognizance.
Paul committed the offences in Windsor on Nov. 16, 2018, and on March 9, 2019. Two more counts of failing to comply with his recognizance and a charge of uttering a death threat were withdrawn by the Crown on Aug. 6.
Breathalyser offence
Dylan James Crews, 20, of Hubbards, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.
Crews pleaded guilty to the charge on Aug. 7. Judge Christopher Manning fined Crews $1,000 and imposed a one-year driving prohibition against him.
Crews committed the offence in Wolfville on May 31. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Crews gave breathalyser readings of 100 and 90.
A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Aug. 7.
Probation offences
Tyler Shawn Coyne, 39, of New Minas, has been fined and sentenced to probation for two counts of failing to comply with probation.
Coyne changed his plea to guilty to one count on May 28 and changed his plea to guilty to the second count on June 11. The matters were adjourned to Aug. 8 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Alan Tufts fined Coyne $200 on each count, for a total of $400 in fines, and sentenced him to nine months of probation on the two charges.
Coyne committed the offences in Canning on Oct. 8, 2018, and in Kentville on Oct. 12, 2018.
Recognizance offence
Sheila Elizabeth Harris, 51, of Windsor, has been handed a conditional discharge with probation for failing to comply with her recognizance by failing to abstain from the consumption of alcohol.
Harris changed her plea to guilty to the charge on May 21 and the matter was adjourned to Aug. 7 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Harris a conditional discharge with six months of probation.
Harris committed the offence in North Grand Pre on Sept. 16, 2018. Charges of assault, resisting arrest by kicking and pulling away from a police constable and failing to comply with her recognizance by failing to keep the peace and to be of good behaviour were dismissed without penalty on Aug. 7.
