This is the latest court report for Kings and West Hants counties.

Conditional discharge for recognizance offences

Lucas Adam Gregory Richards, 22, of North Kentville, has been handed a conditional discharge with probation for three counts of failing to comply with his recognizance; one for failing to keep the peace and to be of good behaviour, one for failing to comply with a condition to have no direct or indirect contact or communication with certain individuals and one for failing to comply with a condition not to be within 100 m of a certain residence or place of education.

Richards pleaded not guilty to the charges in December 2016 and the matters were adjourned for trial. Following the trial, Judge Ronda Van Der Hoek handed down her decision on May 30, finding Richards guilty of the three offences. The matters were adjourned to July 25 to allow time for a pre-sentence report to be prepared and for sentencing.

Richards was handed a conditional discharge with 15 months of probation on each count, to be served concurrently.

Richards committed the offences in North Kentville on Nov. 18, 2016. He was also charged with sexual assault and sexual touching involving a person under the age of 16 but was found not guilty of these charges following his trial.

Breathalyser offence

Stephen Murray Porter, 58, of Hants Border, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Porter pleaded guilty to the charge on July 24. Judge Ronda Van Der Hoek fined him a total of $1,950 and imposed a one-year driving prohibition against him.

Porter committed the offence in Windsor on May 5. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Porter gave breathalyser readings of 180 and 170.

Failed to attend court

Wade Russell Moriarity, 32, of Morden, has been sentenced to time in custody for failing to attend court in accordance with a Promise to Appear.

Moriarity pleaded guilty to the charge on July 26. Judge Christopher Manning sentenced him to 15 days in custody.

Moriarity committed the offence in Kentville on April 10.

Sentenced to probation

A Hants County woman is serving 18 months of probation for two charges of criminal negligence causing bodily harm.

Michelle Parker, 25, of Pembroke, was sentenced in Windsor provincial court on July 20. She entered guilty pleas to the charges.

The incidents occurred in Pembroke between Jan. 26 and 28, 2017. Two additional assault charges were dropped with the Crown offering no evidence.

Time deemed served

A Windsor man has settled an assault causing bodily harm conviction with time deemed served.

Mark Graham Saulnier, 55, was found guilty of the charge in Windsor provincial court on July 20. He was subsequently sentenced to one day in custody, with the time deemed served at the time of sentencing.

The charge was laid in relation to an incident that occurred in Windsor on Feb. 26, 2016.
