Conditional sentence with house arrest
Daniel Burton Brian Coleman, 24, of New Minas, will serve a term of imprisonment in the community for committing an assault causing bodily harm.
He has also been handed a suspended sentence with probation for committing mischief by willfully damaging an individual’s property to a value not exceeding $5,000 and has been sentenced to time deemed served and probation for uttering a threat to cause bodily harm or death.
Coleman changed his pleas to guilty to the assault causing bodily harm charge and to the mischief charge in July. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Coleman changed his plea to guilty to the charge of uttering a threat prior to his sentencing on Feb. 28.
Judge Claudine MacDonald handed Coleman a nine-month conditional sentence order with house arrest for the first 135 days, to be followed by daily curfew from 11 p.m. to 6 a.m. for the remaining time, for committing an assault causing bodily harm. This is to be followed by one year of reporting probation. Coleman has also been ordered to pay $146.55 in restitution to the victim.
Coleman was handed a suspended sentence with one year of reporting probation – to be served concurrently – in relation to the mischief charge. He has been ordered to pay $520 in restitution to the victim.
Coleman was sentenced to one day in custody deemed served and one year of reporting probation – to be served concurrently – for uttering a threat.
Coleman committed the offences in Kentville on Sept. 26, 2017, on April 13, 2017, and on July 17, 2018, respectively.
Conditional sentence with house arrest
Joshua Alexander Provost, 27, of Berwick, will serve a term of imprisonment in the community for unlawfully being inside a house and for failing to comply with his recognizance.
Provost was present in Kentville provincial court in custody on Feb. 28. He was originally charged with break, enter and theft but pleaded guilty to the lesser offence of unlawfully being inside a house. He changed his plea to guilty to the charge of failing to comply with his recognizance.
Judge Claudine MacDonald handed Provost a six-month conditional sentence order with house arrest for the first three months, to be followed by daily curfew from 11 p.m. to 6 a.m. for the remaining time, for unlawfully being inside a house. This is to be followed by one year of reporting probation.
Provost was handed a 15-day conditional sentence, to be followed by one year of reporting probation, to be served concurrently, for failing to comply with his recognizance.
Provost committed the offences in Berwick on Sept. 13, 2018. A charge of stealing methadone was dismissed on Feb. 28 with the Crown offering no evidence.
Conditional discharge for sexual assault
Kody Bourque, 25, of Waterville, has been handed a conditional discharge with probation for committing a sexual assault.
Bourque pleaded guilty to the charge on Jan. 15. The matter was adjourned to Feb. 28 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Claudine MacDonald handed Bourque a conditional discharge with one year of reporting probation.
Bourque committed the offence in Waterville on Aug. 4, 2018.
Breathalyser offence
Christopher Hernandez, 42, of Coldbrook, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.
Hernandez pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Hernandez a total of $1,200 and imposed a one-year driving prohibition against him.
Hernandez committed the offence in Coldbrook on Dec. 4, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hernandez gave breathalyzer readings of 130 and 120.
Breathalyser offence
Alexander Lewis Crouse-Bower, 24, of New Minas, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Crouse-Bower pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Crouse-Bower a total of $1,000 and imposed a one-year driving prohibition against him.
Crouse-Bower committed the offence in New Minas on Nov. 24, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Crouse-Bower gave breathalyser readings of 90 and 90.
Refused breathalyser
Matthew Michael Wallace Garnhun, 29, of Greenwood, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.
Garnhun pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Garnhun a total of $1,300 and imposed a one-year driving prohibition against him.
Garnhun committed the offence in South Greenwood on Sept. 9, 2018.
Unlawfully possessed opioid
Allen Frederick Mahaney, 52, of Kentville, has been fined for unlawfully possessing an opioid.
Mahaney pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Mahaney a total of $200.
Mahaney committed the offence in New Minas on Dec. 17, 2018.
Unlawfully possessed cannabis
Scott Anthony Negus, 45, of New Minas, has been fined for unlawfully possessing cannabis marijuana.
Negus pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Negus a total of $300.
Negus committed the offence in New Minas on April 30, 2018.
The charge against a co-accused, Emily Davidson, 22, of New Minas, was withdrawn on Feb. 26.
Undertaking offence, failed to attend court
Richard Steven Moore, 37, of Kentville, has been fined for failing to comply with his undertaking by failing to abstain from the consumption of alcohol or other intoxicating substances; failing to attend court in accordance with a Promise to Appear in which he had been named and failing without lawful excuse to attend court in accordance with a recognizance.
Moore pleaded guilty to the charges on Feb. 26. Judge Alan Tufts fined Moore $250 on each of the three charges, for a total of $750 in fines.
Moore committed the offences in Kentville on Jan. 27, March 13 and May 22, 2018.
Probation offence
Nathan Patrick Thomas Ward, 29, of Habitant, has been handed a conditional discharge with probation for failing to comply with probation by failing to report as directed.
Ward pleaded guilty to the charge on Jan. 15. The matter was adjourned to Feb. 28 to allow time for a pre-sentence report to be updated and for sentencing.
Judge Claudine MacDonald handed Ward a conditional discharge with nine months of reporting probation.
Ward committed the offence in Kentville between June 27 and Sept. 20, 2018.
Undertaking offence
Robert John Pick, 38, of Kentville, has been fined for failing to comply with his undertaking.
Pick pleaded guilty to the charge on Feb. 26. Judge Alan Tufts fined Pick a total of $100.
Pick committed the offence in Kentville on Dec. 17, 2018.
