This is the latest court report for Kings and West Hants counties.

Possession for purpose of trafficking

Michael Wayne Nicholson, 33, of Waterville, has been handed a suspended sentence with probation for unlawfully possessing methamphetamine for the purpose of trafficking.

Nicholson changed his plea to guilty in September 2017 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On Nov. 26, Judge Ronda Van Der Hoek handed Nicholson a suspended sentence with three years of probation and fined him $200 in victim surcharges. He has been ordered to return to court every six months for the duration of his probation.

Nicholson has been ordered to complete 240 hours of community service work. The court granted a forfeiture order for property seized in relation to the controlled drugs and substances Act charge and granted a primary DNA order. The court imposed a 10-year firearm prohibition against Nicholson.

Nicholson committed the offence in Berwick on Aug. 2, 2016. The charge against two co-accused in the case, Crystal Ann Nicholson, 52, and Jenna Lyn Hobson, 27, was dismissed with the Crown offering no evidence.

Conditional sentence for firearm, property offences

Leonard Wade Greenough, 25, of Windsor, has been handed a conditional sentence order with house arrest followed by daily curfew for possessing a firearm, a Mossberg bolt action rifle, without holding the necessary licence and two counts of possessing stolen property valued at less than $5,000.

Greenough changed his pleas to guilty to the charges on Oct. 5 and the matters were adjourned to Nov. 27 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Greenough a 12-month conditional sentence order on the three charges, with house arrest for the first 140 days, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining time. The conditional sentence will be followed by two years of probation. Greenough was fined a total of $600 in victim surcharges.

Greenough committed the offences in Windsor on March 6. Several other charges were dismissed on Nov. 27, including breaking and entering a house and stealing firearms; break, enter and theft from the Windsor and Hantsport Railway Company, stealing scrap metal from the Windsor and Hantsport Railway Company of a value not exceeding $5,000, stealing a donation box with change from Tim Hortons, possessing a break and enter instrument, a baseball bat, and transferring a firearm without authorization.

Suspended sentence for multiple offences

Jonathan Lloyd French, 36, of Halifax, has been handed a suspended sentence with probation for a variety of offences, including resisting a police officer engaged in the execution of his duty; two counts of failing to comply with probation, failing to attend court as directed by a judge, stealing property of a value not exceeding $5,000 from the Kentville Save Easy and stealing property of a value not exceeding $5,000 from the New Minas Superstore.

French was found guilty on the charges of resisting a police officer and one count of failing to comply with probation in June 2010. The matters were adjourned for sentencing. French committed the offences in New Minas on Oct. 31, 2008.

He pleaded guilty on Oct. 4, 2018, to failing to attend court in Kentville as directed by a judge on Jan. 6, 2011. The matter was adjourned for sentencing.

French pleaded not guilty to the charges of stealing property from the Kentville Save Easy and the other count of failing to comply with probation in September 2009. French changed his pleas to guilty on Oct. 4, 2018, and the matters were adjourned for sentencing. He committed these offences in Kentville on May 19, 2009.

On Nov. 27, Judge Alan Tufts handed French a suspended sentence with 12 months of reporting probation on each of the six charges, to be served concurrently.

Three more counts of failing to attend court as directed by a judge were withdrawn on Nov. 27.

Conditional sentence for assault

Amanda Susan Cosgrove, 31, of Kentville, has been handed a conditional sentence order with daily curfew for committing an assault.

Cosgrove pleaded guilty to the charge on Sept. 25 and the matter was adjourned to Nov. 29 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek handed Cosgrove a four-month conditional sentence order with daily curfew from 10 p.m. to 6 a.m. for the entire time, followed by 12 months of reporting probation. The court also granted a secondary DNA order.

Cosgrove committed the offence in Kentville on Aug. 17.

Breathalyser offence

Chancelor Jack Snelgrove, 25, of Windsor, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Snelgrove pleaded guilty to the charge on Nov. 27. Judge Christopher Manning fined Snelgrove a total of $1,560 and imposed a one-year driving prohibition against him.

Snelgrove committed the offence in Windsor on Oct. 14. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Snelgrove gave breathalyser readings of 190 and 180.

Breathalyser offence

Marcus Alexander MacKay, 35, of Ardoise, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

MacKay pleaded guilty to the charge on Nov. 27. Judge Christopher Manning fined MacKay a total of $1,950 and imposed a two-year driving prohibition against him.

MacKay committed the offence in Ardoise on Oct. 13. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. MacKay gave breathalyser readings of 240 and 230.

Breathalyser offence

Alicia Marie Hunter, 41, of North Kentville, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

In January, Hunter pleaded not guilty to this charge and to a charge of operating a motor vehicle while her ability to operate was impaired by alcohol or a drug. The matters were adjourned for trial. The trial was held on June 20. The charge of operating a motor vehicle while her blood alcohol level exceeded the legal limit was adjourned for a decision. A motion for a directed verdict on the other charge was granted, essentially dismissing the charge.

On Nov. 27, Judge Alan Tufts found Hunter guilty of operating a motor vehicle while her blood alcohol level exceeded the legal limit. He fined her a total of $1,300 and imposed a one-year driving prohibition against her.

Hunter committed the offence in North Kentville on Oct. 6, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hunter gave breathalyser readings of 120 and 110.

Suspended sentence for uttering threat

Kenneth Harold Kelly, 40, of West Brooklyn, has been handed a suspended sentence with probation for uttering a threat to an individual to burn her property.

Kelly changed his plea to guilty on Nov. 29. Judge Ronda Van Der Hoek handed Kelly a suspended sentence with 12 months of reporting probation. The court also granted a secondary DNA order.

Kelly committed the offence in Baxter’s Harbour between Sept. 1 and Oct. 3, 2017. Charges of committing mischief by willfully damaging an individual’s tires, criminal harassment and assault were dismissed on Nov. 29 with the Crown offering no evidence.

Undertaking, probation offences

Melody Susan Margaret Gallie, 24, of no fixed address, has been sentenced to time deemed served for failing to comply with her undertaking by failing to abstain from any direct or indirect communication with an individual and for failing to comply with probation.

Gallie pleaded guilty to the charges on Nov. 27. She was sentenced to one day in custody deemed served on both charges.

Gallie committed the offences in Pictou on April 20.

Conditional discharge for undertaking offence

Jorden William Keddy, 23, of Kentville, has been handed a conditional discharge with probation for failing to comply with his undertaking by failing to abstain from the consumption of alcohol.

Keddy changed his plea to guilty on Nov. 29. Judge Ronda Van Der Hoek handed Keddy a conditional discharge with six months of probation. Keddy has been ordered to make a $50 donation to a charity of his choice as part of the probation and must provide the court with a receipt.

Keddy committed the offence in Kentville on May 22.
