This is the latest court report for Kings and West Hants counties.

DRUG, WEAPON CHARGES

Kyle Keith Patrick Hefford-Power, 28, of Greenwood, has been sentenced to jail time for unlawfully possessing cannabis for the purpose of distributing it and possessing a cross-bow while prohibited from doing so.

Hefford-Power changed his pleas to guilty on July 22. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On Nov. 4, Judge Christopher Manning sentenced Hefford-Power to three months in custody for unlawfully possessing cannabis for the purpose of distributing it. The court granted a secondary DNA order and granted a forfeiture order for offence-related property.

Hefford-Power was sentenced to six months in custody, to be served consecutively, for possession a cross-bow while prohibited. The court granted a lifetime firearm prohibition in relation to the charge.

Hefford-Power committed the offences in Greenwood on Oct. 17, 2018. A charge of possessing a prohibited weapon – a throwing star, a.k.a. a shuriken – without holding the necessary licence was withdrawn on Nov. 4.

CONDITIONAL SENTENCE WITH HOUSE ARREST

Randall Henry Prime, 49, of Wolfville, will serve a period of imprisonment in the community for failing to comply with probation by failing to abstain absolutely from the use, consumption and possession of alcohol and non-medically prescribed drugs; failing to comply with probation with regard to reporting and failing to attend court in accordance with a promise to appear in which he had been named.

Prime changed his pleas to guilty on Aug. 15 and the matters were adjourned to Nov. 6 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning handed Prime a 60-day conditional sentence order with house arrest for the first 30 days, to be followed by daily curfew from 10 p.m. to 6 a.m., on the three charges. The conditional sentence will be followed by one year of reporting probation.

Prime committed the offences in Wolfville on Sept. 7, 2018; and in Kentville between Aug. 23 and Oct. 26, 2018, and on Nov. 1, 2018.

CONDITIONAL SENTENCE WITH HOUSE ARREST

John Douglas Crowell, 35, of Hortonville, will serve a period of imprisonment in the community for stealing property from Shoppers Drug Mart of a value not exceeding $5,000 and for failing to attend court in accordance with a promise to appear in which he had been named.

Crowell pleaded guilty to the charges on March 26. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On Nov. 6, Judge Ronda Van Der Hoek handed Crowell a 60-day conditional sentence order for stealing property from Shoppers Drug Mart and a 30-day conditional sentence order, to be served consecutively, for failing to attend court.

Crowell will serve house arrest for the first 45 days, to be followed by daily curfew from 9 p.m. to 6 a.m. for the remaining 45 days. As part of the conditional sentence, Crowell has been ordered to pay $100 in restitution to Shoppers Drug Mart. The conditional sentence will be followed by one year of probation.

Crowell committed the offences in Wolfville on Aug. 20, 2018; and in Kentville on Oct. 23, 2018.

BREATHALYSER OFFENCE

Cameron Bruce Hoyt, 26, of White Rock, has been sentenced to intermittent custody for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Hoyt pleaded guilty to the charge on Sept. 10 and the matter was adjourned for sentencing. On Nov. 5, Judge Christopher Manning sentenced Hoyt to 30 days of intermittent custody, to be served from Fridays at 8 p.m. to Mondays at 6 a.m. beginning Nov. 8. Hoyt will be on probation while not in custody. The court imposed a two-year driving prohibition against him.

Hoyt committed the offence in White Rock on May 9. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hoyt gave breathalyzer readings of 110 and 110.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Nov. 5.

BREATHALYSER OFFENCE

Laura Ann Patterson, 38, of Weston, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Patterson changed her plea to guilty on Nov. 6. Judge Christopher Manning fined Patterson $1,500 and imposed a one-year driving prohibition against her.

Patterson committed the offence in Aylesford on April 7. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Patterson gave breathalyser readings of 130 and 120.

A charge of operating a conveyance while her ability to do so was impaired to any degree by alcohol or a drug or both; and a charge of willfully obstructing an RCMP member engaged in the execution of his duty conducting an impaired driving investigation and administering an approved screening device by placing a coin in her mouth were dismissed on Nov. 6 with the Crown offering no evidence.

BREATHALYSER OFFENCE

David J. Furlong, 33, of Piccadilly, Newfoundland and Labrador, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Furlong pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Furlong $1,200 and imposed a one-year driving prohibition against him.

Furlong committed the offence in Kingston on Aug. 9. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Furlong gave breathalyser readings of 110 and 100.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Nov. 5.

FAILED TO COMPLY WITH DEMAND

Tamara Irvine, 27, of Harbourville, has been fined for failing or refusing to comply with a demand made to her by a police officer under Section 320.27 or 320.28 of the Criminal Code. These sections of the Criminal Code relate to testing drivers for the presence of alcohol and drugs.

Irvine pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Irvine $2,000 and imposed a one-year driving prohibition against her.

Irvine committed the offence in Wolfville on July 20.

FAILED TO COMPLY WITH DEMAND

Angela Leigh Fraser, 38, of Brooklyn, has been fined for refusing to comply with a demand made by a police officer under Section 320.27 of the Criminal Code. This section of the Criminal Code relates to testing drivers for the presence of alcohol and drugs.

Fraser pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Fraser $2,000 and imposed a one-year driving prohibition against her.

Fraser committed the offence in Greenwood on Aug. 31.

FAILED TO STOP FOR POLICE

Alfred Chesley Fagan, 56, of Greenwood, has been fined and sentenced to probation for failing to stop his conveyance as soon as was reasonable in the circumstances while being pursued by a police officer.

Fagan pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Fagan $500 and sentenced him to 12 months of reporting probation.

Fagan committed the offence in Greenwood on July 3. Charges of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both and possessing a weapon – a 9 mm handgun – for a purpose dangerous to the public peace were withdrawn on Nov. 5.

FINED FOR DRUG POSSESSION

Justin Lawrence Mader, 38, of Granville, has been fined for unlawfully possessing cocaine.

Mader was originally charged with possession for the purpose of trafficking but pleaded guilty to the lesser, included offence of possession on Nov. 7. Judge Ronda Van Der Hoek fined Mader $900.

Mader committed the offence in New Minas on Dec. 3, 2018.

FINED FOR DRUG POSSESSION

Mark Anthony Higdon, 39, of Kentville, has been fined for unlawfully possessing diazepam.

Higdon was originally charged with possession for the purpose of trafficking but pleaded guilty to the lesser, included offence of possession on Oct. 22. The matter was adjourned to Nov. 6 for sentencing. Judge Christopher Manning fined Higdon $500.

A charge of unlawfully possessing lorazepam for the purpose of trafficking was withdrawn on Nov. 6.

Higdon is facing several other charges, including pointing a handgun at two individuals; two counts of assault, uttering a threat, carrying a handgun for the purpose of committing an offence and failing to comply with his undertaking.

The court granted an application from Higdon’s defence lawyer to withdraw from the matters on Nov. 6. The remaining charges have been adjourned to Dec. 6 for election and plea and for Higdon to arrange legal counsel.

FIREARMS OFFENCE

Caleb Mack, 37, of North Kentville, has been fined for storing long guns without securing them with a lock, contrary to the Storage, Display, Transportation and Handling of Firearms by Individuals Regulations.

Mack pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Mack $300 and granted a forfeiture order for firearms seized. The court imposed a three-year firearm prohibition against Mack.

Mack committed the offence in North Kentville on April 11.

ASSAULT CAUSING BODILY HARM

Emily Sara Hudgins, 26, of Aylesford, has been handed a conditional discharge with probation for committing an assault causing bodily harm.

Hudgins pleaded not guilty on Feb. 12 and a trial was held on July 23. A decision was rendered on Sept. 4 and Hudgins was found guilty. The matter was adjourned to Nov. 6 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning handed Hudgins a conditional discharge with 12 months of reporting probation.

Hudgins committed the offence in Aylesford on Dec. 19, 2018.

ASSAULT, UNDERTAKING OFFENCE

Anthony James Pinch, 28, of North Kentville, has been handed a conditional discharge with probation for committing an assault and failing to comply with his undertaking.

Pinch pleaded guilty to the assault charge on July 30. The matter was adjourned to Nov. 7 to allow time for a pre-sentence report to be prepared and for sentencing. Pinch changed his plea to guilty to the undertaking charge on Nov. 7.

Judge Christopher Manning handed Pinch a conditional discharge with one year of probation on the two charges. The court imposed a three-year firearm prohibition in relation to the assault charge.

Pinch committed the offences in New Minas on April 4 and in Kentville on May 21. A charge of carrying a weapon – a metal pole – in committing an assault was withdrawn on Nov. 7.

UTTERED THREAT

Lisa Leonore Rand, 35, of Kentville, has been handed a conditional discharge with probation for uttering a threat to an individual to cause bodily harm or death.

Rand pleaded guilty to the charge on Aug. 13. The matter was adjourned to Nov. 7 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Rand a conditional discharge with 12 months of probation.

Rand committed the offence in Kentville on May 16.

STOLE FROM STORE

Jason Scott Rudderham, 44, of Hunts Point, has been fined for stealing a grocery cart full of consumable goods from Walmart.

Rudderham pleaded guilty to the charge on Nov. 5. Judge Christopher Manning fined Rudderham $250.

Rudderham committed the offence in New Minas on Aug. 25.
