Jail time for robbery, other offences

Catlin Stewart Cooke, 26, of Greenwood, has been sentenced to jail time for robbery, two counts of failing to comply with his recognizance and failing to comply with probation.

Cooke pleaded guilty in April to using violence in stealing $75 from a man, assault and failing to comply with probation. The matters were adjourned to July 5 to allow time for a pre-sentence report to be prepared and for sentencing. Cooke consented to being remanded in custody until his sentencing date. On July 5, Cooke pleaded guilty to two counts of failing to comply with his recognizance.

Judge Claudine MacDonald sentenced Cooke to 17 months in custody on a go forward basis on the charge of using violence in stealing money from a man. Consideration was given for the time Cooke spent remanded in custody. This will be followed by two years of probation. Cooke has been ordered to report within two days of his release from custody. Cooke was ordered to pay $75 in restitution to the victim within the first six months of probation. The court imposed a mandatory firearm prohibition against Cooke. This takes affect as of his sentencing date and will end 10 years after his release from his 17-month sentence.

MacDonald entered a judicial stay on the assault charge and sentenced Cooke to one day in custody, to be served concurrently, on the charge of failing to comply with probation. Cooke was sentenced to one day in custody, to be served concurrently, on each of the two recognizance charges.

Cooke committed the offences in Greenwood on Aug. 2, 2016, and on March 30 and April 12, 2017.

Fined for Employment Support and Income Assistance Act offence

Amanda Lee Mahaney, 38, of Kentville, has been fined after pleading guilty to an offence under the Employment Support and Income Assistance Act.

Mahaney pleaded not guilty in May 2016 to an original charge of defrauding the Department of Community Services of in excess of $5,000. Mahaney maintained her not guilty plea to this charge but on July 5, she pleaded guilty to a charge under the Employment Support and Income Assistance Act. Mahaney was fined a total of $520.

Mahaney committed the offence in Kentville between Feb. 1, 2013, and Feb. 28, 2014.

Breathalyser offences

Aubrey Vernon Keddy, 73, of Coldbrook, has been sentenced to intermittent custody for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Keddy pleaded guilty to the charge on July 4. A notice of increased penalty was filed, as Keddy has a prior conviction. Judge Claudine MacDonald sentenced Keddy to 30 days of intermittent custody, to be served from Fridays at 9 p.m. to Mondays at 6 a.m. beginning July 7. Keddy was also sentenced to 18 months probation and was fined $100 in victim surcharges. The court imposed a four-year driving prohibition against Keddy.

Keddy committed the offence in Aylesford on April 30. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Keddy gave breathalyser readings of 220 and 210.

 

John Christian Elmers, 42, of Auburn, has been sentenced to time in custody for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Elmers pleaded guilty on July 4. The court imposed a two-year driving prohibition. Submissions were made and the matter was adjourned to July 5 for the continuation of sentencing. Judge Claudine MacDonald sentenced Elmers to 20 days in custody.

Elmers committed the offence in Berwick on March 15. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Elmers gave breathalyser readings of 110 and 100.

 

Eric Ronald Croucher, 19, of Thorburn, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Croucher pleaded guilty to the charge on July 4. Judge Claudine MacDonald fined Croucher a total of $1,300 and imposed a one-year driving prohibition against him.

Croucher committed the offence in Wolfville on March 25. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Croucher gave breathalyser readings of 130 and 120.

 

Cassie Elizabeth Daniels, 24, of Berwick, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

Daniels pleaded guilty to the charge on July 4. Judge Claudine MacDonald fined Daniels a total of $1,300 and imposed a one-year driving prohibition against her.

Daniels committed the offence in Kingston on April 8. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Daniels gave breathalyser readings of 170 and 150.

 

Mary Whyte, 59, of Kingston, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

Whyte pleaded guilty to the charge on July 4. Judge Claudine MacDonald fined her a total of $1,560 and imposed a one-year driving prohibition against her.

Whyte committed the offence in Kingston on May 6. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Whyte gave breathalyser readings of 180 and 180.

 

Bradley Dean Wiseman, 28, of Greenwood, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Wiseman pleaded guilty to the charge on July 4. Judge Claudine MacDonald fined him a total of $1,300 and imposed a one-year driving prohibition against him.

Wiseman committed the offence in Aylesford on May 14. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Wiseman gave breathalyser readings of 110 and 100.

Refused breathalyser

Tammy Lynn Lockhart, 43, of Greenwood, has been fined for failing to comply with a demand from a police officer to provide samples of her breath for analysis to determine the concentration, if any, of alcohol in her blood.

Lockhart pleaded guilty to the charge on July 4. Judge Claudine MacDonald fined her a total of $1,300 and imposed a one-year driving prohibition against her. Lockhart is eligible to apply for the ignition interlock program after three months.

Lockhart committed the offence in Kingston on March 26. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.

Probation, recognizance offences

Justin Lee Waye, 32, of Kentville, has been fined for two counts of failing to comply with his recognizance and failing to comply with probation.

Waye pleaded guilty to the charges on July 4. Judge Claudine MacDonald fined Waye a total of $195 on the first recognizance charge. Waye was fined a total of $130 for failing to comply with probation and was fined a total of $130 for the second recognizance charge.

Waye committed the offences in North Kentville on June 2 and in New Minas on June 11.
