This is the latest court report for Kings and West Hants counties.

Intermittent custody for various offences

Martin Leroy Cleveland Jr., 26, of Kentville, has been sentenced to intermittent custody for two counts of assault; two counts of uttering a threat to cause bodily harm or death and failing to comply with probation. He has also been sentenced to time deemed served for five counts of fraud and two counts of failing to comply with his recognizance.

Cleveland was present in Kentville provincial court in custody on May 7, when he pleaded guilty to the 12 charges. On the two counts of assault, the two counts of uttering threats and for failing to comply with probation, Judge Ronda Van Der Hoek sentenced Cleveland to 90 days of intermittent custody. This will be served from Fridays at 9 p.m. to Mondays at 9 a.m. beginning on May 11 and continuing until the sentence is served. Cleveland was also sentenced to 12 months of probation.
Cleveland was sentenced to time deemed served for the five counts of fraud and two counts of failing to comply with his recognizance. The court granted a stand-alone restitution order for $1,160 payable to one of the fraud victims.

Cleveland committed the offences in Kentville on Feb. 15, between March 3 and 17 and on March 9 and 11; in Wolfville between March 5 and 9 and in New Minas between March 5 and 9. Charges of causing a disturbance in a public place, three more counts of failing to comply with probation, two counts of possessing stolen property valued at less than $5,000 and four more counts of failing to comply with his recognizance were withdrawn on May 7.

Possessed illegal tobacco

Sean Michael Finch, 40, of Grande Bend, Ontario, has been fined for possessing tobacco on which tax had not been paid, contrary to the Revenue Act, and unlawfully selling, offering for sale or having in his possession cigarettes not stamped in accordance with the Excise Act.

Finch pleaded not guilty to the charges in February 2017. On May 9, 2018, evidence was heard and exhibits were entered at Finch’s trial. Judge Alan Tufts found Finch guilty on both counts.

Finch was fined a total of $8,004 in relation to the Revenue Act charge and was fined a total of $4,400 in relation to the Excise Act charge.

Finch committed the offences in Kentville on Jan. 5, 2017.

Uttered threat, committed mischief

Matthew David Pineo, 30, of Lakeville, has been handed a conditional discharge with probation for uttering a death threat and committing mischief by breaking a window.

Pineo changed his pleas to guilty on May 9. Judge Alan Tufts handed Pineo a conditional discharge with 12 months of probation. Pineo was fined a total of $200 in victim surcharges and was ordered to make a $100 charitable donation. He was also ordered to pay $500 in restitution to the victim of the mischief offence.

Pineo committed the offences in Grafton on Jan. 6. A charge of assault and a charge of uttering a threat to burn an individual’s personal property were dismissed on May 9.

Assaults, undertaking offence

John Allen MacMillan, 46, of Kentville, has been handed a conditional discharge with probation for two counts of assault and for failing to comply with his undertaking by failing to refrain from having any direct or indirect communication with an individual.

MacMillan pleaded guilty to the charges on March 13. The matters were adjourned to May 10 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek handed MacMillan a conditional discharge with 18 months of probation on each of the three charges, to be served concurrently.

MacMillan committed the offences in Kentville on Jan. 6 and 8.

Conditional discharge for uttering threat

Blaine Perry Giberson, 30, of no fixed address, has been handed a conditional discharge with probation for uttering a death threat.

Giberson changed his plea to guilty on Jan. 24 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On May 9, Judge Ronda Van Der Hoek handed Giberson a conditional discharge with nine months of probation.

Giberson committed the offence in Kingston on Aug. 12, 2017.

Breathalyser offence

Janice Anne Wells, 53, of Wolfville, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

Wells pleaded guilty to the charge on May 8. Judge Ronda Van Der Hoek fined Wells a total of $1,820 and imposed a one-year driving prohibition against her.

Wells committed the offence in Wolfville on Feb. 24. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Wells gave breathalyser readings of 210 and 190.

Breathalyser offence

Kristofer Spencer Josey, 23, of Dartmouth, has been fined for having the care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Josey changed his plea to guilty on May 10. Judge Ronda Van Der Hoek fined Josey a total of $1,300 and imposed a one-year driving prohibition against him.

Josey committed the offence in New Minas on Aug. 27, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Josey gave breathalyser readings of 100 and 100.

Drove while disqualified

Laura Elaine Llewellyn, 33, of Kentville, has been fined for operating a motor vehicle while disqualified from doing so by an order of the court.

Llewellyn pleaded guilty to the charge on May 8. Judge Ronda Van Der Hoek fined Llewellyn a total of $195 and imposed a one-year driving prohibition against her.

Llewellyn committed the offence in Kentville on Oct. 7, 2017.

Failed to attend court

Charlene Ann Coyle, 50, of Kingston, has been fined for failing to attend court in accordance with a Promise to Appear in which she had been named.

Coyle pleaded guilty to the charge on May 8. Judge Ronda Van Der Hoek fined Coyle a total of $65.

Coyle committed the offence in Kentville on March 27.
