This is the latest court report for Kings and West Hants counties.

Conditional sentence with house arrest

Christopher Travis Kollman, 22, of Lower Sackville, has been handed a conditional sentence order, including house arrest, for several counts of possession of stolen property and break and enter with intent to commit an indictable offence.

Kollman pleaded guilty in January to seven counts of break and enter with intent to commit an indicatable offence, four counts of possessing stolen property and a charge of dangerous driving causing bodily harm to two individuals. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Prior to his sentencing on May 1, Kollman also pleaded guilty to possessing a stolen credit card. In total, Judge Ronda Van Der Hoek handed Kollman a nine-month conditional sentence order, including house arrest for the first four-and-a-half months and daily curfew from 10 p.m. to 6 a.m. for the remaining four-and-a-half months.

The conditional sentence will be followed by one year of probation. Kollman was fined a total of $2,500 in victim surcharges. In relation to the charge of dangerous driving causing bodily harm, the court imposed a five-year driving prohibition against Kollman.

Kollman committed the offences in Somerset, Chester, Lockhartville, Hantsport, Valley, South Rawdon, Rawdon, Stewiacke, Noel, Mount Uniacke, Kennetcook and Cheverie between June 17, 2017, and July 5, 2017. Another 10 charges against Kollman were withdrawn on May 1.

One co-accused, Jaylen Parsons, 22, of Lower Sackville, was sentenced in April and a second co-accused, Dylan Nowlan, 20, of Beaverbank, was scheduled to make his next court appearance on May 4.

Suspended sentence for indecent act

Nicholas Kent Coldwell, 31, of Coldbrook, has been handed a suspended sentence with probation for committing an indecent act with intent to insult or offend.

Coldwell was originally charged with sexual assault but pleaded guilty to the lesser, included offence of committing an indecent act with intent to insult or offend on March 8. The matter was adjourned to May 3 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Claudine MacDonald handed Coldwell a suspended sentence with 15 months of probation and imposed a 10-year Sex Offender Information Registration Act (SOIRA) order against him. Coldwell was also fined $100 in victim surcharges.

Coldwell committed the offence in Coldbrook on March 31, 2017. Another charge of sexual assault was dismissed on May 3.

Intermittent custody for assault

Joseph Albert States, 47, of Kentville, has been sentenced to intermittent custody for committing an assault.

States changed his plea to guilty on March 22 and the matter was adjourned for sentencing. On May 3, submissions were made and exhibits were entered at a sentencing hearing. Judge Claudine MacDonald sentenced States to 60 days of intermittent custody, to be served from Fridays at 9 p.m. to Mondays at 5:30 a.m. beginning on May 4 and continuing every weekend until the sentence is served. States was also sentenced to 12 months of probation, including $81 in restitution payable through the court to the benefit of the assault victim. The court imposed a five-year firearm prohibition against States and granted a secondary DNA order.

States committed the offence in North Kentville on Nov. 25, 2016.

Intermittent custody for driving while disqualified

Barry Kimberley Rawding, 42, of Welton Corner, has been sentenced to intermittent custody for operating a motor vehicle while disqualified.

Rawding pleaded guilty to the charge in February and the matter was adjourned to April 30 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts sentenced Rawding to 30 days of intermittent custody, beginning May 5 at 9 p.m. to May 7 at 5:30 a.m. and continuing each weekend until the sentence is served. Rawding will be serving non-reporting probation while not in custody. The court imposed a four-month driving prohibition against Rawding, to be served consecutively to any other prohibition presently imposed. Rawding was also fined $100 in victim surcharges.

Rawding committed the offence in Somerset on Dec. 15, 2017. A charge of failing to comply with probation was withdrawn on April 30.

Conditional sentence for probation offence

Nicholas Sheldon Lee Corkum, 20, of Kentville, has been handed a conditional sentence order with daily curfew and has been sentenced to probation for failing to comply with probation by failing to report to and to be under the supervision of a probation officer.

Corkum pleaded guilty to the charge on Feb. 27. The matter was adjourned to April 30 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Corkum a two-month conditional sentence order with daily curfew from 10 p.m. to 5 a.m., to be followed by 10 months of probation.

Corkum committed the offence in Kentville between Oct. 31, 2016, and Oct. 30, 2017.

Breathalyser offence

Brian Lutz, 50, of Canada Creek, has been sentenced to intermittent custody for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Lutz pleaded guilty to the charge in January. The court imposed a two-year driving prohibition against Lutz and the matter was adjourned to May 1 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Alan Tufts sentenced Lutz to 30 days of intermittent custody, to be served on Saturdays at 9 p.m. to Mondays at 5:30 a.m. beginning May 12 and continuing every weekend until the sentence is served. Lutz was also sentenced to 12 months of probation and was fined $100 in victim surcharges.

Lutz committed the offence in Canada Creek on Sept. 3, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Lutz gave breathalyser readings of 250 and 250.

Curative treatment conditional discharge

Phillip Leo LeBlanc, 37, of Windsor, has been handed a curative treatment conditional discharge for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

LeBlanc pleaded guilty to the charge in January and the court imposed a one-year driving prohibition against him. The matter was adjourned to May 1 to allow time for a pre-sentence report to be prepared and for a curative treatment application. Judge Ronda Van Der Hoek handed LeBlanc a curative treatment conditional discharge with 18 months of probation.

LeBlanc committed the offence in Upper Vaughan on Oct. 13, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. LeBlanc gave breathalyser readings of 280 and 270.

Fined for fraud

Michael Gordon Johnston, 56, of Lockhartville, has been fined for defrauding Brooklyn Office Supplies of a sum of money.

Johnston changed his plea to guilty in January and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On May 1, the Crown received confirmation that Johnston had paid restitution. Judge Ronda Van Der Hoek fined Johnston a total of $13.

Johnston committed the offence in Windsor between Aug. 1, 2015, and April 6, 2016. A charge of, through the medium of a contract obtained by false pretense, causing Brooklyn Office Supplies to deliver products and services of a value not exceeding $5,000 was withdrawn on May 1.

Conditional discharge for assault

Vincent John Burgess, 36, of Greenwood, has been handed a conditional discharge with probation for committing an assault.

Burgess was originally charged with assault causing bodily harm. He maintained his not guilty plea to this charge but pleaded guilty to the lesser, included offence of assault on April 30. Judge Alan Tufts handed Burgess a conditional discharge with 12 months of probation and fined him $100 in victim surcharges.

Burgess committed the offence in Greenwood on April 1, 2017.

Conditional discharge for assault

Jason Colin Jeffery Romeril, 41, of Canning, has been handed a conditional discharge with probation for committing an assault.

Romeril changed his plea to guilty in January and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Romeril a conditional discharge with nine months of probation and fined him $200 in victim surcharges.

Romeril committed the offence in Canning between June 1 and 30, 2016. Another count of assault and a charge of sexual assault were dismissed on May 3.

Conditional discharge for uttering threat

James Francis Dill, 71, of North Kentville, has been handed a conditional discharge with probation for uttering a threat to cause bodily harm to an individual.

Dill changed his plea to guilty on April 30. Judge Alan Tufts handed Dill a conditional discharge with 12 months of probation and fined him $100 in victim surcharges.

Dill committed the offence in North Kentville on June 28, 2017. A charge of criminal harassment was dismissed on April 30.

Failed to comply with undertaking

Jason Gerald Wayne Hartt, 19, of Centreville, has been handed a conditional discharge with probation for failing to comply with his undertaking.

Hartt changed his plea to guilty on April 30. Judge Alan Tufts handed Hartt a conditional discharge with three months of probation, including either 10 hours of community service work or a $100 donation to a registered charity.

Hartt committed the offence in Centreville between July 18 and 21, 2017.

Probation offence

Kolby Luke Jordan, 23, of Kentville, has been sentenced to time deemed served and fined for failing to comply with probation.

Jordan pleaded not guilty to the charge in January. Evidence was heard at his trial on March 29 and April 23. On May 3, Judge Claudine MacDonald found Jordan guilty. He was sentenced to one day in custody deemed served and was fined a total of $390.

Jordan committed the offence in Kentville on Nov. 7, 2017.
