Time deemed served for break, enter, theft

A former Spryfield man has been sentenced to time deemed served for a break, enter and theft he pleaded guilty to almost 15 years ago.

Raymond Lee Foley, 44, pleaded guilty to the break, enter and theft charge on Dec. 20, 2002. The Crown withdrew another count of break, enter and theft and a charge of possessing stolen property valued at less than $5,000.

The matter was adjourned to Feb. 10, 2003, for sentencing but Foley was not present. Foley appeared in Windsor provincial court on Sept. 5, having returned from British Columbia. A warrant was vacated and Foley was sentenced to one day in custody deemed served.

Foley committed the offence in Lower Vaughan between Oct. 28 and Nov. 3, 2002.

Conditional sentence orders

Kevin Charles Smith, 47, of Sheffield Mills received a 45-day conditional sentence and a $100 Victims Services fine for failure to report to probation between Feb. 1 and Sept. 26, 2016.

 

Phillip Carl Caldwell, 38, of Greenwood has received a five-month conditional sentence and one year’s probation of charges of assaulting a woman and breach of conditions relating to an incident June 21, 2016 in Greenwood. He also has a mandatory DNA requirement and he was handed a five-year firearms ban. Caldwell also entered not guilty pleas to charges of making death threats and breach of conditions between Jan. 15 and 29 in Greenwood. His trial has been set for Nov. 14.

Probation for assault, uttering threat

Jeremy E. Wentzell, 22, of Wolfville was sentenced to a year’s probation and $200 in Victim’s Services fines after he was found guilty of two charges Aug. 30 in Kentville. He was charged with assault and threats to cause bodily harm. Five other charges related to the Aug. 23, 2016 incident in Wolfville were dismissed.
